The regular meeting of the Zoning Board of Appeals was called to order at 7:01 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.
 
Roll call was taken.
 
The following Board Members were present:

It was moved by Foley and seconded by Beardsley to approve the minutes of the March 14, 2016, Regular Meeting, with the following amendment:

PUBLIC HEARING – 15 WOODS ROAD
 
At   7:04 p.m., Chairman Seaton opened the public hearing in regard to the application submitted by Edmond and Tami Caporaso for property located at 15 Woods Road seeking the following variance of Sections 3.4 and 4.1.C. of the Bethany Zoning Regulations for a detached garage:
·         A 33.5-foot variance of the side yard setback to allow a 16.5-foot side yard setback.
 
Chair Seaton read the legal notice for the public hearing.  Roll call was taken.
 
Member Beardsley stated she is a neighbor of Amy Ravitz, who is an abutting property owner to the subject property, and that this will not interfere with her judgment.
 
It was noted that all members visited the subject property except for Chair Jim Seaton.
 
Present for this application were Tami and Edmond Caporaso, applicants and owners of record.
 
Mrs. Tami Caporaso noted the following during discussion:
·         Would like to locate garage at end of driveway.
·         Owned property for 3 years.  House was built in 1935. 
·         A lot of ledge and a lot of slope on property.
·         Land slopes down past shed and ground is soft.
·         Garage would be less visual to the neighbor on the hill if located in proposed area.
 
Commission members noted:
·         Proposed garage needs to be 25 feet from the tank.
·         1935 house was built; can’t attach garage to house.
·         There are no permits for the house due to the age of home.
·         Applicant has not done any test pits in area proposing garage.
 
Chairman Seaton noted that the Board received the following items relative to the subject application.  Exhibit identification was assigned as noted:
1)      Exhibit 1A  Letter from Isabel Kearns, ZEO, to Tami and Edmund Caporaso dated January 21, 2017, Re:  Proposal to locate detached garage not in compliance at 15 Woods Road.
2)      Exhibit 1B – Letter from Tami Caporaso of 15 Woods Road, dated March 21, 2017, Re:  Subject property not located within 500 feet of a town boundary.

The Board recommended that the applicant conduct exploratory work to test the proposed area for ledge.
 
At 7:32 p.m., Chair Seaton recessed the public hearing and continued the public hearing to the next regular meeting on Monday, May 8, 2017, at 7:00 p.m.

APPROVED MINUTES OF THE BETHANY CONSERVATION COMMISSION, MARCH 9, 2017
 
 
Present were Bruce Loomis, Brian Eitzer and Patricia Winer
Absent were Cathy Rives, Shaukat Khan and Matthew Popp
 
The meeting was called to order at 8:08pm. The minutes of November 8th were tabled again as the necessary members to approve them were not present. Winer moved to approve the minutes of February16 with amendments as follows: the second sentence of the eighth paragraph should read, "The Conservation Commission's interpretation is that the town's regulations require that the Conservation Commission get the opportunity to review and provide advice on open space prior to the Planning and Zoning decision, even though that advice does not need to be heeded. (Subdivision Regulations 11.4. c). Loomis seconded the motion, and the minutes were approved.
 
As correspondence the Commission received the Aquarion Champions of Conservation Awards entry form and information. Bruce mentioned the possibility of nominating Barry Collins again. The discussion of whether we have a candidate will be continued.
 
P&Z update as of their March meeting:
New regulations on LED lighting are still under discussion. Kevin McSherry reported on two bills in the legislature, one dealing with fees in lieu and the other with the conveyance tax. Both would allow towns to use money derived from these sources to be dedicated to open space. On the issue of communication between the Conservation Commission and P&Z, Bruce will write a letter about it to P&Z, as he did not have the opportunity to speak about the question at the meeting.
 
Budget
It was agreed that we should still propose $100,000 for the LAF, but we shouldn't go for a 100% increase in our own budget. We will ask for $750 instead, an increase over $500, which we have had as a budget figure for many years.
 
The Commission went into executive session at 8:31 to discuss Conservationist of the Year. We exited at 8:37.
 
Revision of the open space inventory:
The Commission reviewed additions to the open space inventory. Bruce has sent the list of Land Trust acquisitions to LInda François to check it with their records. Adjustments will need to be made in the text of the Open Space Plan to bring it into conformity with the additions to the tables.
 
Open space watch list:
We will put the northern part of the Woodward property abutting Northrup Road on our watch list, as  it adjoins the designated open space, and as Mr. Woodward has given up the connection between the upper and lower parts of the property that he retained, The possibility of putting the former Uniroyal property on the watch list for agricultural or recreational space was also discussed.
 
We will all check the amendments to the tables in the Open Space Plan and confirm them at our next meeting.
 
Brian moved to adjourn at 9:07. Patsy seconded. The motion was passed.

    The Commission would like to meet with the Conservation Commission to discuss this matter and would like Town Attorney present also.
     
  2. Letter from Isabel Kearns, ZEO, to Matthew Micros of 667 Amity Road, LLC, dated March 6, 2017, Re:  Extensive Tree Cutting not in accordance with approved site plan (667-687 Amity Road).

PUBLIC HEARING
 
  • Proposed amendment to Section 7 – Signs and Parking & Loading Regulations – to add Subsection 7.3.1. – Special Exception for lighted signs in the Business and Industrial Zone
     
At 7:18 p.m., Chair Brinton called the public hearing continuation to order.   Roll call was taken.  Chair Brinton read the notice for the public hearing continuation. 
 
Hiram Peck, Planning Consultant, stated that at the March 1st public hearing there were comments made from the public and that he is in the process of incorporating the comments in the draft amendment.
 
Chair Brinton asked if anyone from the public would like to speak in favor of the application or against the application.   The following members of the public spoke:
    • Theron Simon of 770 Amity Road (Lock, Stock & Barrel), Bethany.
    • Peter Verab of 720 Amity Road (Amity Gardens), Bethany.
 
Some items noted by Commission during public hearing were:
    • Restricting LED signs to not be moving signs.
    • Commission can regulate size, location and manner of signs.
 
At 7:36 p.m., it was moved by Calhoun and seconded by Shea to recess the public hearing and continue it to the next Regular Meeting on Wednesday, May 3, 2017, in the Commission Meeting Room.  Hearing will start at 7:15 p.m.
Voting for:  Brinton, Calhoun, Shea, Buchta, McDonald.

NEW BUSINESS
 
  1. 755 AMITY ROAD (Airport property), Application #2017-004 submitted by Town of Bethany for a sign permit (hangar)
     
The Commission formally received the application.  No one was present to speak on behalf of this application.
 
Isabel Kearns, ZEO, stated the sign is going to be located on the hangar.  Also, Ms. Kearns stated the signage on the Airport property is maxed out. 
 
Hiram Peck, Planning Consultant, recommended the Commission review the old historic sign compared to the new proposed sign for the hangar and review the total signage at the site.
 
Further discussion and appropriate action on the application was deferred until the Commission’s Special Meeting scheduled for May 3, 2017.  Tabled.
 
 
  1. Discussion of community housing options -
 
Hiram Peck, Planning Consultant, briefly discussed with the Commission local options for housing.  Tabled.
 
 
  1. Discussion with John Paul Garcia regarding 667/687 AMITY ROAD, Soccer Fields, Temporary “CO” for field and revised field locations and grading  -
 
Present for this discussion were:
    • John Paul Garcia, P.E./L.S., representing the applicants.
    • John Paoletti, contractor.
    • Steve Coxon, one of the owners.
 
Mr. Garcia submitted a revised plan entitled, “Lighting and Landscaping Plan”, revised to March 22, 2017.
 
Some items noted by Mr. Garcia were:
    • Soccer fields being graded.
    • Client would like temporary CO for soccer fields.
 
 
    • Foundation for building needs to be prepped but too much rain.
    • Building sitting in back field.
    • Discussion with neighbor to grant grading easement to eliminate retaining walls.
    • Can’t obtain building permit until QVHD approves septic and QVHD won’t approve until sand is in place.  Ground very wet.
 
Isabel Kearns, ZEO, stated that Planning and Zoning grants Certificate of Compliance but if building is not completed, cannot grant.
 
 
 
Some items noted by the Commission were:
    • More trees cut down than the site plan shows.
    • Applicant will be coming back with a Landscaping plan after building constructed to provide buffer plantings.
 
Hiram Peck, Planning Consultant, suggested Mr. Garcia prepare a staging plan and a narrative to include the changes and submit to the Commission.

OLD BUSINESS
 
  1. 200 LITCHFIELD TURNPIKE, Application #2017-003 submitted by Andrew Keene for a Home Occupation Permit for a Farm stand with weekly distribution
 
The Commission formally received the application.  Present for this discussion was Andrew Keene, applicant.
 
Chair Brinton stated she takes care of the animals at the farm and this will not interfere with her vote.
 
The Commission was concerned with parking on Litchfield Turnpike.  Mr. Keene stated there will be no parking on road and that the farm stand will be inside barn.  Also, Mr. Keene added additional hours of operation for Saturdays and Sundays.
 
Isabel Kearns, ZEO, prepared a draft resolution.  Commission members discussed and proceeded to deliberate.  It was moved by Calhoun and seconded by Buchta to approve the following resolution for Application #2017-003:
 
Whereas, Andrew Keene, applicant, applied to the Planning and Zoning Commission on March 1, 2017, for a Home Occupation Permit to operate a farm stand for weekly distribution located at 200 Litchfield Turnpike;
 
Whereas, Tammy Jackson of The Institute of Professional Practice, Inc. authorized Andrew Keene to apply for a Home Occupation Permit for a farm stand for weekly distribution located at 200 Litchfield Turnpike in an e-mail dated February 24, 2017;
 
Whereas, the Commission, at its regular meeting of March 1, 2017, considered the statement of use, narrative, testimony and other pertinent application information relating to this home occupation application;
 
Now Therefore, the Commission makes the following findings of fact and decision regarding this application:
  1. Alexis Rinaldi, Quinnipiack Valley Health District Representative, signed off on the back of the application form on March 2, 2017, indicating her approval.
  2. Rod White, Fire Marshal, signed off on the back of the application form on    February 28, 2017 indicating his approval.
     
     
     
     
  3. The Commission received a letter from Ron Walters, representative of the South Central Connecticut Regional Water Authority, in which he states he has no comment.
     
    Now Therefore Be It Resolved, that pursuant to Section 4.3.E.4.b. of the Town of Bethany Zoning Regulations, amended to October 30, 2015, the Bethany Planning and Zoning Commission approves the application of Andrew Keene for a Home Occupation Permit to operate a farm stand for weekly distribution located at 200 Litchfield Turnpike, as outlined in the Statement of Use dated February 24, 2017.
    Vote:  5 to 0.
    Voting were:  Brinton, Calhoun, Shea, Buchta, McDonald.
    Unanimous approval.
     
    It was moved by Buchta and seconded by Shea to authorize Isabel Kearns, Zoning Enforcement Officer, to approve the sign for the farm stand located at 200 Litchfield Turnpike.
    Vote:  5 to 0.
    Voting were:  Brinton, Calhoun, Shea, Buchta, McDonald.
    Unanimous approval.

  • Received complaint regarding 12 Pleasant Drive – Grieger, used as hangout till late and noise from diesel trucks.

MINUTES OF THE BETHANY INLAND WETLANDS COMMISSION REGULAR MEETING OF MON
The regular meeting of the Inland Wetlands Commission was called to order at 7:35 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.
 
The following members of the Commission were present:

NEW BUSINESS 
 
  1. 63 Sargent Drive, Discussion with Bill Grieger regarding IW Permit #1182
 
Present for this discussion was Bill Grieger, owner of record. 
 
Mr. Grieger received a letter from Isabel Kearns, IWEO, dated February 16, 2017, Re:  Inland Wetlands Permit #1182, Condition B, revised plan showing removal of invasive species.
 
The Commission and Mr. Grieger had a discussion regarding the removal of the invasive species and recommended Mr. Grieger  find someone that can guide him in the process of the removal of the invasive species.
 
Mr. Grieger will come back to the Commission with plan showing removal.  Tabled.
 
 
OLD BUSINESS
 
  1. 39 Porter Hill Road, Application #1273 submitted by David Christensen for an IW Permit to repair and maintenance of pond
 
Present for this application was John Connolly of Christensen Landscape Services, LLC of Northford, Connecticut, representing the property owners.  Mr. Connolly stated the plans have been revised with the suggested comments from the February Meeting,
 
The Commission discussed and proceeded to deliberate.  It was moved by Smith and seconded by Scanlon to approve Application #1273 submitted by David Christensen for an Inland Wetlands Permit to repair and for the maintenance of the pond located at 39 Porter Hill Road as presented in the application, testimony and in accordance with the following submitted plans prepared by Godrey Hoffman Associates, LLC, North Haven, Connecticut:
  1. “Site Plan”, dated February 27, 2017, revised to March 23, 2017, Drawing No. C-1.0.
  2. “Erosion & Sedimentation Control Details & Notes”, dated February 27, 2017, revised to March 23, 2017, Drawing No. C-2.0.
     
 
In addition, this permit is subject to the following conditions including the standard conditions found on the Land Records, Volume 93, Page 802 and Page 803:
  1. Instead of the Geotextile silt fence around the check dams as shown on the plan, the applicant shall place stacked haybales.  Once the area is stabilized and vegetated, then haybales shall be removed.
  2. Before commencing of any work, the applicant shall check with the Inland Wetlands Enforcement Officer on the weather conditions.
 
This approval is based on the fact that if the applicant follows the submitted plans as shown there should be minimal or no adverse impact to the surrounding wetlands.  The plan shows the relocation of the dewatering bag and haybales surrounding all the work instead of silt fence so therefore they can be roughly placed on the westerly side of the pond and the wetlands surrounding.
Vote 4 to 0.
Voting for:  Sullivan, Smith, Scanlon, Huxley.
Unanimous approval.
 
 
  1.  90 Pole Hill Road (Bethany Community Garden), Application #1278 submitted by Town of Bethany for an IW Permit to locate a second 7’ by 7’ shed on wood base
     
Present for this application was MaryEllen Unger of the Bethany Community Garden Committee.
 
Member Scanlon stated she will abstain as she is Treasurer of the Community Garden Club.
 
Commission members discussed and proceeded to deliberate.  It was moved by Smith and seconded by Huxley to approve Application #1278 submitted by the Bethany Community Garden Club for an Inland Wetlands Permit to locate a 7-foot by 7-foot shed on a wooden base located at 90 Pole Hill Road as presented in the application, testimony and in accordance with the submitted plan with hand-drawn markings dated February 8, 2017.
 
This approval is based on the fact that if the applicant follows the submitted plan as shown there should be minimal or no adverse impact to the onsite wetlands. 
Vote 3 to 0.
Scanlon abstained.
Voting for:  Sullivan, Smith, Huxley.
Unanimous approval.

No one was present for this discussion.  Mr. John Paul Garcia had submitted a revised Sequence of Construction and work dated March 2, 2017, and plan revised to March 2, 1017.
 
Commission members discussed and proceeded to deliberate.  It was moved by Smith and seconded by Scanlon to modify the Cease and Desist Order dated December 26, 2014, for property located at 10 Northrup Road, to allow the “Sequence of Construction and work” as outlined in the letter submitted by John Paul Garcia, P.E./L.S., dated January 30, 2017 (revised to March 2, 2017) and as shown in the plan submitted entitled, “Remediation Plan” dated November 5, 2015, revised to March 2, 2017, prepared by John Paul Garcia & Associates, Bethany, Connecticut, to be completed.    The Cease and Desist Order dated December 26, 2014, shall remain in effect until the end of the four year period as stated.
Vote 4 to 0.
