MINUTES OF THE BETHANY INLAND WETLANDS COMMISSION REGULAR MEETING OF MON
The regular meeting of the Inland Wetlands Commission was called to order at 7:35 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.
 
The following members of the Commission were present:
         Kristine Sullivan, Vice-Chair, Acting as Chair
         Brian Smith, Member
         Nancy Scanlon, Member
         Rob Huxley, Alternate Member, seated as voting member
 
The following members of the Commission were absent:
          Alexandra Breslin, Chair
          Roger Hathaway, Member
 
 
NEW BUSINESS 
 
  1. 63 Sargent Drive, Discussion with Bill Grieger regarding IW Permit #1182
 
Present for this discussion was Bill Grieger, owner of record. 
 
Mr. Grieger received a letter from Isabel Kearns, IWEO, dated February 16, 2017, Re:  Inland Wetlands Permit #1182, Condition B, revised plan showing removal of invasive species.
 
The Commission and Mr. Grieger had a discussion regarding the removal of the invasive species and recommended Mr. Grieger  find someone that can guide him in the process of the removal of the invasive species.
 
Mr. Grieger will come back to the Commission with plan showing removal.  Tabled.
 
 
OLD BUSINESS
 
  1. 39 Porter Hill Road, Application #1273 submitted by David Christensen for an IW Permit to repair and maintenance of pond
 
Present for this application was John Connolly of Christensen Landscape Services, LLC of Northford, Connecticut, representing the property owners.  Mr. Connolly stated the plans have been revised with the suggested comments from the February Meeting,
 
The Commission discussed and proceeded to deliberate.  It was moved by Smith and seconded by Scanlon to approve Application #1273 submitted by David Christensen for an Inland Wetlands Permit to repair and for the maintenance of the pond located at 39 Porter Hill Road as presented in the application, testimony and in accordance with the following submitted plans prepared by Godrey Hoffman Associates, LLC, North Haven, Connecticut:
  1. “Site Plan”, dated February 27, 2017, revised to March 23, 2017, Drawing No. C-1.0.
  2. “Erosion & Sedimentation Control Details & Notes”, dated February 27, 2017, revised to March 23, 2017, Drawing No. C-2.0.
     
 
In addition, this permit is subject to the following conditions including the standard conditions found on the Land Records, Volume 93, Page 802 and Page 803:
  1. Instead of the Geotextile silt fence around the check dams as shown on the plan, the applicant shall place stacked haybales.  Once the area is stabilized and vegetated, then haybales shall be removed.
  2. Before commencing of any work, the applicant shall check with the Inland Wetlands Enforcement Officer on the weather conditions.
 
This approval is based on the fact that if the applicant follows the submitted plans as shown there should be minimal or no adverse impact to the surrounding wetlands.  The plan shows the relocation of the dewatering bag and haybales surrounding all the work instead of silt fence so therefore they can be roughly placed on the westerly side of the pond and the wetlands surrounding.
Vote 4 to 0.
Voting for:  Sullivan, Smith, Scanlon, Huxley.
Unanimous approval.
 
 
  1.  90 Pole Hill Road (Bethany Community Garden), Application #1278 submitted by Town of Bethany for an IW Permit to locate a second 7’ by 7’ shed on wood base
     
Present for this application was MaryEllen Unger of the Bethany Community Garden Committee.
 
Member Scanlon stated she will abstain as she is Treasurer of the Community Garden Club.
 
Commission members discussed and proceeded to deliberate.  It was moved by Smith and seconded by Huxley to approve Application #1278 submitted by the Bethany Community Garden Club for an Inland Wetlands Permit to locate a 7-foot by 7-foot shed on a wooden base located at 90 Pole Hill Road as presented in the application, testimony and in accordance with the submitted plan with hand-drawn markings dated February 8, 2017.
 
This approval is based on the fact that if the applicant follows the submitted plan as shown there should be minimal or no adverse impact to the onsite wetlands. 
Vote 3 to 0.
Scanlon abstained.
Voting for:  Sullivan, Smith, Huxley.
Unanimous approval.
 
 
  1. 74 MUNSON ROAD, Harold, Thomas and Dina Durley, Updated on Cease and Desist Order issued December 7, 2016.
 
No one was present for this discussion.  The Commission would like Isabel Kearns, IWEO, to follow up on this item.  Tabled.
 
 
 
 
 
 
  1. Discussion regarding Raccio Drive – Proposal from Diversified Technology ConsultantsTabled.
     
 
  1. Continue Show Cause Hearing regarding Cease and Desist Order, dated       October 21, 2014, to Mrs. Bitina Patel of 10 Northrop Road, extension of patio, stonewall along the pond, waterfall and clear cutting of trees within the 150-foot upland review area without permit
 
No one was present for this discussion.  Mr. John Paul Garcia had submitted a revised Sequence of Construction and work dated March 2, 2017, and plan revised to March 2, 1017.
 
Commission members discussed and proceeded to deliberate.  It was moved by Smith and seconded by Scanlon to modify the Cease and Desist Order dated December 26, 2014, for property located at 10 Northrup Road, to allow the “Sequence of Construction and work” as outlined in the letter submitted by John Paul Garcia, P.E./L.S., dated January 30, 2017 (revised to March 2, 2017) and as shown in the plan submitted entitled, “Remediation Plan” dated November 5, 2015, revised to March 2, 2017, prepared by John Paul Garcia & Associates, Bethany, Connecticut, to be completed.    The Cease and Desist Order dated December 26, 2014, shall remain in effect until the end of the four year period as stated.
Vote 4 to 0.
Voting for:  Sullivan, Smith, Scanlon, Huxley.
Unanimous approval.

  1. It was moved by Scanlon and seconded by Smith to approve, as submitted, the minutes of the February 27, 2017, Regular Meeting.
