First Selectwoman Gorski called the meeting of the Board of Selectmen to order at 7:30 p.m.  The meeting was held in the Selectman’s Conference Room.  The meeting began with the Pledge of Allegiance.
APPROVAL OF MINUTES
First Selectwoman Gorski called for a motion of approval for the minutes of the meeting of March 13, 2017.  The motion was moved by Selectman Shea and seconded by Selectman Hurlburt.  There were no changes to the minutes.  The minutes were then approved on a unanimous vote.
TAX REFUNDS
First Selectwoman Gorski called for a motion for Tax Refunds.  The motion was moved by Selectman Hurlburt to refund to Kelly Donavan the sum of $6.50, to Margaret Duke the sum of $31.92, to Nicholas Marcarelli the sum of $96.38 and to Steven Antonellis the sum of $7.80 all for overpayment of taxes.  Selectman Shea seconded the motion.  The vote taken was unanimous.
APPOINTMENTS TO BOARDS AND COMMISSIONS
Selectman Shea moved to appoint Rob Huxley as an alternate member to the Inland Wetlands Commission.  His term would expire June 30, 2018.  Selectman Hurlburt seconded the motion.  The vote taken was unanimous.
Selectman Hurlburt moved to appoint Andre Sofair to represent Bethany on the Quinnipiac Valley Health District.  His term would expire June 30, 2018.  Selectman Shea seconded the motion. 
The vote taken was unanimous.
ANY OTHER MATTER PROPER TO COME BEFORE THE MEETING
Sharon Huxley was present to discuss with the Selectmen the condition of the Announcers Stand and the fence at the Airport.  The Lions Club and the Pony Club have kept the fence in repair in the past.  Since more extensive repair is needed they are reaching out to the Town for extra financial assistance.  Sharon had photos of the condition of the Announcers Stand.  Matt Belcourt, a Hamden resident but an active member of the Bethany Horsemen has volunteered to help with the repair of the announcers stand roof provided the Town can supply a lift to get the materials on the roof.  The Selectmen agreed to refer this matter to the Board of Finance. 
 
 
 
 
 
UPDATE ON STATE BUDGET
First Selectwoman Gorski has attended COG meetings where the State of Connecticut budget has been discussed.  Most Mayors and First Selectmen agreed they were not including the teacher’s pension in their budgets.  The Board of Finance will meet tomorrow and possibly set a date for the Budget Hearing.

Adjournment was called at 8:02 p.m. after a motion was moved by Selectman Shea and seconded by Selectman Hurlburt.  The vote taken was unanimous.

Chairman Grabowski and First Selectwoman Gorski called the special joint meeting of the Board of Finance and Board of Selectmen to order at 7:08 p.m.  The meeting was held in the Selectmen’s Conference Room of the Bethany Town Hall.
The purpose of this meeting was to have Attorney McSherry discuss with the Board of Finance and Board of Selectmen procedures to follow for the upcoming Budget Hearing and Annual Town Meeting.  
Attorney McSherry explained that the Board of Finance would present to the Budget Hearing on April 24, 2017 the expenditures and revenues as approved at their last meeting, using the latest figures from the Governor’s budget for Revenues.
The Annual Town Meeting will be held on Monday May 15, 2017 for the purpose of approving the Expenditures and Revenues if completed, and the Capital Expenditures.  If the total budget is not approved the meeting will be adjourned.  A new date would be set for a Special Town Meeting to complete the budget.   The State would like to standardize the mill rate for automobile tax bills to be the same throughout the State. This rate is yet to be determined.  The real estate tax bills would go out based on last year’s mill rate in July if the total budget is not complete and approved.   A supplemental tax bill would have to be sent out in January for the second half to make adjustments for the approved budget.  The Town will lose revenue for the difference between the present rate and a standardized rate for motor vehicle taxes.   Selectman Shea would like the public to know how the teacher’s pension contribution would affect the mill rate if the State of Connecticut makes the Town’s pay for it. 
Adjournment was called at 7:58 after a motion was moved by Selectman Don Shea and seconded by Sharon Huxley .  The vote taken was unanimous.

First Selectwoman Gorski called the meeting of the Board of Selectmen to order at 4:35 p.m.  The meeting was held in the Selectmen’s Conference Room of the Bethany Town Hall.  The purpose of this meeting was to approve the Call for the Annual Town Meeting.
APPROVAL OF CALL
Selectman Hurlburt moved the motion to approval the Call for the Annual Town Meeting.  First Selectwoman Gorski seconded the motion.  The vote taken was two (2) yes votes for approval.  Selectman Shea was absent from this meeting.
Selectman Hurlburt and First Selectwoman Gorski signed the Call for the Annual Town Meeting.
ADJOURNMENT
Adjournment was called at 4:37 p.m. after a motion was moved by Selectman Hurlburt and seconded by First Selectwoman Gorski.  The vote taken was unanimous.

Bethany Conservation Commission
May 11, 2017
Unapproved Minutes
 
  1. The meeting was called to order at 8:08 by Bruce Loomis.  Also in attendance were Brian Eitzer, Patsy Winer and Matthew Popp. Absent were Shaukat Khan and Cathy Rives.
  2. Matthew Popp was appointed as a voting member in place of Cathy Rives for this meeting.
  3. Bruce noted that in the future all minutes need to state if they have been approved or are unapproved.
  4. Patsy moved to accept the minutes of the April 13, 2017 meeting, Brian seconded.  It was noted that in the first line Shaukat was misspelled.  With that correction, the minutes were approved unanimously.
  5. The only correspondence was a letter from the USGS-FEMA about an upcoming RISK Map meeting (meeting date 5/23/17) dealing with flood risk in the Housatonic watershed.
  6. No current bills, though it was noted that the bills for the Bethany Community School awards and the Conservationist of the Year award would be arriving soon.
  7. Bruce reported on the budget hearing which he and Patsy attended where the amount to transfer to the Open Space fund was raised to our requested $100,000.  There was then a discussion of the budget and the upcoming town meeting.
  8. Bruce gave a recap of rid litter day.  He noted that he didn’t hear about the results from the organizers but heard elsewhere that not as much was collected this years as in years past.  He also noted the passing of Stu Horton whom had worked on this issue.
  9. Bruce gave a recap of events from the recent Planning and Zoning Committee meeting.  He was unsure if the lighted sign hearing was ended or continued but the issue would be carried forth next month.  The Bethany Airport Hanger is caught in the sign issue as their sign went up before receiving a permit.  Planning and Zoning would like to meet with the Conservation Commission prior to their next meeting on June 7.  Bruce agreed to check on an alternate date as several members of our commission could not be there on that date.
  10. Bruce tabled the issue on the Open Space Appendices.
  11. Bruce initiated a discussion on next year’s Conservationist of the Year award and whether we wanted to create limits on whom could receive the donation that goes with the award.
  12. Patsy suggested we all read the cluster development article in The Habitat prior to the next meeting so that we can advise P&Z when they update their regulations.
  13. Patsy moved to adjourn at 9:00 Matthew seconded and the motion passed.

The Special Meeting of the Planning and Zoning Commission was called to order at 7:04p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

PUBLIC HEARING CONTINUATION

At 7:26 p.m., Chair Brinton called the public hearing continuation to order.   Roll call was taken.  Chair Brinton read the notice for the public hearing continuation. 
 
Hiram Peck, Planning Consultant, distributed to Commission members draft regulations and photographs of signs.  He continued to review with the Commission.
 
Chair Brinton asked if anyone from the public would like to speak in favor of the application or against the application.   The following members of the public spoke:
    • Fran Doba of Amity Road.
    • Rob White of Bethmour Road.
    • John Paul Garcia, P.E./L.S. of 190 Fairwood Road.
 
Some items noted by Commission during public hearing were:
    • Brightness of lights and if LED lights dim automatically or must they be adjusted.
    • What is standard for LED lighting?
    • Consider context of sign before approving.
    • Hiram mentioned Special Permit process is important.
 
At 8:12 p.m., it was moved by Calhoun and seconded by Sullivan to close the public hearing on the subject application.
Unanimous approval.
 
NEW BUSINESS
 
  1. 41 MARION ROAD, Application #2017-005 submitted by Mary Isbell for a Special Exception Permit for an Accessory Apartment
The Commission formally received the application.  No one was present to speak on behalf of this application.
 
It was moved by Calhoun and seconded by Shea to schedule a public hearing date of Wednesday, June 7, 2017, at the next regular meeting in the Commission Meeting Room of the Bethany Town Hall.
Unanimous approval.
 
 
  1. Discussion regarding accessory apartments
 
Some items noted by Commission members during discussion were:
  • ZEO stated we don’t currently inspect these apartments.  Hiram Peck suggested that inspections should occur.
  • Hiram stated the changing of ownership doesn’t get reported often which lessens revenue to town.
  • If changes are made, owners should have to come before the board.
  • Per Hiram, the owner of the property needs to live in one of the units.
  • Attorney McSherry stated that if the title changes, inspection should be needed.  The Commission would need to decide on the appropriate fee.
  • Owners should have to come back to the Commission otherwise there are no regulations, fire marshal needs to be involved and fees need to be discussed.

OLD BUSINESS
 
  1. 755 AMITY ROAD (Airport property), Application #2017-004 submitted by Town of Bethany for a sign permit (hangar)
 
Isabel Kearns, ZEO, stated the sign is not in compliance with the free-standing sign regulations.
Member Sullivan asked if the sign was grandfathered because the hangar was preserved.
Attorney McSherry stated it can be considered grandfathered though the building is a little different and that it doesn’t have to be exactly what was there, though it shouldn’t exceed prior sign by a massive amount.
Chair Brinton is concerned that businesses would want the same exception to procedure as airport is being granted and she would like the same standard for both.
Hiram Peck, Planning Consultant, stated he wants to determine the size of the original sign by using the photo and will have the dimensions by the next meeting.

ZONING ENFORCEMENT OFFICER’S REPORT
Isabel Kearns, ZEO, reported on the following:       
  • 12 Pleasant Drive, Grieger – ZEO reported that the plants and vegetation was changed and owner should have brought this before the Inland Wetlands Commission,
  • Attorney McSherry recommended the ZEO send letter to Grieger that he has to go to the Inland Wetlands Commission.
 
 
It was moved by Sullivan and seconded by Buchta to entertain comments from John Paul Garcia regarding 667 Amity Road – soccer fields.
 
Mr. Garcia noted the following:
  • Has a meeting with DEEP on May 11, 2017, for a permit.
  • Soccer fields under Stop Work Order as there is a drainage problem and erosion control measures need to be followed.
  • Septic was installed and checked by QVHD.
  • Structural engineer of record needs to sign off on structural fill for building.
  • Rain has delayed the process
  • Revised site plan includes easement for grading rights.  There is change regarding fencing – 4 feet high around the fields to keep cars off and an increase net size along Amity Road and 49 feet nets to keep balls out of the road.
  • Discussion on how material will be taken off-site, landscaping, field construction to start in August.

PUBLIC HEARING CONTINUATION – 15 WOODS ROAD
 
At 7:06 p.m., Chairman Seaton opened the public hearing continuation in regard to the application submitted by Edmond and Tami Caporaso for property located at 15 Woods Road seeking the following variance of Sections 3.4 and 4.1.C. of the Bethany Zoning Regulations for a detached garage:
·         A 33.5-foot variance of the side yard setback to allow a 16.5-foot side yard setback.
 
Chairman Seaton read the notice for the public hearing continuation.  Roll call was taken.
 
Present for this application were Tami and Edmond Caporaso, applicants and owners of record.
 
Mr. or Mrs. Caporaso noted the following in discussion:
·         Hired excavation professional, Don Paradise, who was also present at public hearing.  Mr. Paradise confirmed that the area being proposed to build the garage is suitable.
·         Mr. Paradise reviewed the map regarding the accessibility to service the septic and the well.
·         Problem with building the garage where the Board suggested because of electric origin.
 
Some items noted by the Board Members were:
·         Member Lasch-Gobilirsch noted she visited the site on May 7, 2017.
·         Discussed septic system being replaced or testing. 
·         Applicant mentioned it’s a new septic system.
 
Chairman Seaton noted that the Board received the following items relative to the subject application.  Exhibit identification was assigned as noted:
1)      Exhibit 2A – Submitted by Mr. Caporaso, photograph of property.
2)      Exhibit 2B – Submitted by applicants, relocation cost for electrical.  Estimate prepared by Balzano Electric.
3)      Exhibit 2C – Letter from neighbor, Josh Hartnett, dated May 5, 2016.
 
Chairman Seaton asked if anyone from the public would like to speak in favor and against the application.   The following member of the public spoke:
·         Mike Brennan, a friend of the family and in the building business, spoke on behalf of the Caporasos.
 
At 7:26 p.m., it was moved by Lasch-Gobilirsch and seconded by Gaw to close the public hearing.

PUBLIC HEARING – 278 SPERRY ROAD
 
At 7:29 p.m., Chairman Seaton opened the public hearing in regard to the application submitted by Abigail Adams of A2 Land Consulting LLC for property located at 278 Sperry Road seeking the following variance of Sections 3.4 and 4.1.D. of the Bethany Zoning Regulations for a detached garage:
·         A 5-foot variance of the maximum height requirement to allow a 40 foot height detached garage located at 278 Sperry Road.
 
Chairman Seaton read the legal notice for the public hearing.  Roll call was taken. Seated this time was Alternate Member Tom Mabry and not Nick DiGiorgi. This was the only change to personnel.
 
Member Beardsley noted that she is friendly with 3 of the neighbors of 278 Sperry Road. None of these individuals were in attendance at the meeting, nor did they send letters regarding this hearing. Member Beardsley did not feel she represented a conflict of interest, so she remained seated.
 
Present for this application was Abigail Adams of A2 Land Consulting, LLC representing the owners of record, David and Peggy Black.
 
Ms. Adams  noted the following in discussion:
·         Reviewed the plan presented on the easel – noted that the sight had a significant slope.
·         Proposed garage with pitched roof – more aesthetically pleasing.
·         The area has been flagged.
·         Screening can be used to enhance the area.
·         Lifts: believes that 11.5 ft. is needed to accommodate lifts; uncertain of necessary height of each floor so lift can fit.
 
Some items noted by Board members were:
·         Member Beardsley visited the site today- she questioned why the loft couldn’t be eliminated, then the variance would be unnecessary; this would result in a 2-floor garage.
·         Chairman Seaton questioned what the hardship is. Ms. Adams explained that the owners have collectible cars and need storage space.
·         Alternate Member Lasch-Gobilirsch confirmed this is for hobby, rather than business.
·         Member Beardsley asked about the height of each level.
·         Board is trying to figure out where the work area is – on the lower level?
·         Chairman Seaton asked if the Fire Department has commented on this project. Isabel Kearns, Zoning Enforcement Officer, replied, “No.” Chairman Seaton wants Ms. Kearns to contact BVFD for comments in case of a fire or other emergency requiring assistance.
·         Alternate Member DiGiorgi had questions about the loft as it relates to the roof line.
·         Member Gaw did a drive-by and noted that this structure would be noticeable from Litchfield Turnpike.
·         Chairman Seaton asked if this structure could go elsewhere on the property.
·         Alternate Member Lasch-Gobilirsch noted that someone could drive into both levels.
·         Member Gaw inquired about the height of the first level – does it need to be 21 feet high? She thinks there is a way to shave the height – asked about lift requirements.
·         Chairman Seaton wants to know how many cars will be housed here.
 
Chairman Seaton noted that the Board received the following items relative to the subject application.  Exhibit identification was assigned as noted:
1)      Exhibit 1A  Letter to Isabel Kearns, Zoning Enforcement Officer, from Regional Water Authority.
2)      Exhibit 1B Letter to Abigail Adams from Isabel Kearns.
3)      Exhibit 1C Letter dated April 21, 2017, to Board Members from Abigail Adams.
 
Chairman Seaton asked if anyone from the public would like to speak in favor and against the application.   There were no comments.
 
At 8:03p.m., it was moved by BeardsleyLasch-Gobilirsch to continue the public hearing to the next regular meeting scheduled for Monday, June 12, 2017, at 7:00 p.m. in the Commission Meeting Room of the Bethany Town Hall.
Voting for:  Seaton, Beardsley, Gaw, Mabry, Lasch-Gobilirsch.

DELIBERATION AND DECISION MAKING SESSION
 
 
15 Woods Road
 
Board members discussed the application and proceeded to deliberate.
 
It was moved by Beardsley and seconded by Gaw that the Bethany Zoning Board of Appeals grants the application of Mr. and Mrs. Edmund Caporaso for the property located at 15 Woods Road and shown on Assessor’s      Map # 122, Lot #35 for a variance of Section(s) 3.4 and 4.1C. Variance is as follows: A 33.5-foot variance of the side yard setback to allow a 16.5-foot side yard setback.
 
This variance is granted subject to the following condition:
 
1.      The variance shall not be effective until a copy of it, certified by the Chairman or the Secretary of the Board, and containing a legal description of the subject property, and specifying the nature of the variance (including the Section of the Zoning Regulations being varied) is filed with the Bethany Town Clerk for recording on the Bethany Land Records by the applicant or owner. A copy of the recorded document shall also be filed with the Zoning Enforcement Officer.
 
Based upon the evidence presented at the public hearing and the facts revealed by the Board’s general acquaintance with the Town and with the general locality of the subject property, the Board makes the following findings:
 
1.                  Special conditions and circumstances exist which are unique to the subject property and which do not affect generally the district to which it is situated. These conditions and circumstances are the topography of the property and the amount of ledge.
 
2.                  A strict and literal interpretation of the Zoning Regulations would deprive the property owner of rights commonly enjoyed by other properties in the same district.
 
3.                  Literal enforcement of the Bethany Zoning Regulations would result in exceptional difficulty or unusual hardship. There is no other place to locate the garage.
 
4.                  The variance will be in harmony with the general purpose and intent of these Regulations.
 
5.                  Due consideration has been given to conserving the public health, safety, convenience, welfare, and property values.

There being no further business to come before the Board, it was moved by Gaw and seconded by Beardsley to adjourn the regular meeting at 8:15p.m.
