The regular meeting of the Inland
Wetlands Commission was called to order at 7:32 p.m. in the Commission Meeting
Room of the Bethany Town Hall , 40 Peck Road , Bethany , Connecticut .
The following members of the
Commission were present:

It was moved by
Sullivan and seconded by Smith to add Application #1209 submitted by Green
Haven Inc. for a Site Plan and Stormwater Management Plan Review to the agenda
for the regular meeting of October 28, 2013, for it was submitted after the
cutoff date of October 18, 2013.
Voting were: Breslin, Sullivan, Hathaway, Smith.
Unanimous
approval.
NEW BUSINESS
1.
Schilf Road,
Application #1206 submitted by the Town of Bethany
for an Inland Wetlands Permit for drainage improvements –
The Commission formally received the application. No one was present to speak on behalf of this
application.
Isabel Kearns, IWEO, stated the Town will be reclaiming the
road, replacing the catch basin tops and replacing pipes if necessary.
In discussion, Commission members noted:
·
Steep drop off end of the cul-de-sac on Schilf
Road.
·
Will schedule site visit.
·
Installation of silt fence at the end of the
cul-de-sac on Schilf Road.
Further discussion and appropriate action on the application
was deferred until the Commission’s next regular meeting on Monday, November
25, 2013. Tabled.
2.
Carmel Road,
Application #1207 submitted by the Town of Bethany for an Inland Wetlands
Permit for drainage improvements –
The Commission formally received the application. No one was present to speak on behalf of this
application.
Isabel Kearns, IWEO, stated the Town will be reclaiming the
road, replacing the catch basin tops and constructing a cross pipe. Member Smith stated the cross pipe has been
completed.
In discussion, Commission members noted:

Is this an after-the-fact permit? Work is being completed now.
·
Will schedule site visit.
Further discussion and appropriate action on the application
was deferred until the Commission’s next regular meeting on Monday, November
25, 2013. Tabled.

54 Rainbow Road , Application #1208 submitted by Tim Boynton for an Inland Wetlands
Permit for drainage repairs –
The Commission formally received the application. Present to speak on behalf of this
application was Tim Boynton, applicant and owner of record.
Isabel Kearns, IWEO, stated that she received a complaint
that gravel was being introduced to this property.
Mr. Boynton reviewed
the proposed project noting:
·
Would like to build a patio.
·
Had water entering in basement.
·
Reconnected the downspouts and added gravel.
In discussion, Commission members noted:
·
Wetlands are well down the slope after looking
at older file.
·
Discharging right above the wetlands
·
Will schedule site visit.
Further discussion and appropriate action on the application
was deferred until the Commission’s next regular meeting on Monday, November
25, 2013. Tabled.
4.
4 and 21 Meyers
Road, Application #1209 submitted by Green Haven, Inc. for an Inland Wetlands
Permit for a Site Plan and a Stormwater Management Plan Review –
The Commission formally received the application. Present to speak on behalf of this
application was Dick Margulis and Chris Hulk.
Dick Margulis briefly discussed the Green Haven proposal.
Chris Hulk of Milone & MacBroom briefly reviewed the set
of plans that were submitted with the application.
In discussion, Commission members noted:

Have not had sufficient time to review to
comment.
Ronald
Walters of the South Central Connecticut Regional Water Authority stated he has
meet with Milone & MacBroom and they have been receptive to the RWA’s
concerns. The RWA will be submitted a
letter with their review comments.
Further discussion and appropriate action on the application
was deferred until the Commission’s next regular meeting on Monday, November
25, 2013. Tabled.
OLD BUSINESS
1.
788 Amity Road , Application #1204 submitted by Amity Road ,
LLC/Anthony Vallillo for an Inland Wetlands Permit for a 4-Lot Subdivision
–
Present to speak on behalf of this application was John Paul
Garcia, P.E./L.S. representing the applicant and Mr. Anthony Vallillo,
applicant and owner of record.
Mr. Garcia stated the plans originally submitted were
revised to address the comments of the Diversified Technology Consultants
letter dated September 20, 2013, and comments from the Inland Wetlands
Enforcement Officer’s letter dated August 19, 2013. The Commission did not receive these plans.
Mr. Garcia submitted a letter of consent to an extension of
time to act on the above Application #1204 for 35 days.
Further discussion and appropriate action on the application
was deferred until the Commission’s next regular meeting on Monday, November
25, 2013. Tabled.
2.
Discussion on
Standard Conditions for Wetlands Permits – It was moved by Sullivan and seconded by
Smith that the Commission incorporate the General Permit Conditions from DEEP
dated May 1, 2006, suggested language into our permit structure be adopted for
every Inland Wetlands Permit issued.
Voting were: Breslin, Sullivan, Hathaway, Smith.
Unanimous approval.
3.
Discussion
regarding Bethany West clearing. (Letter
from Roman Mrozinski/Southwest Conservation District) – The Commission received a letter from the
Conservation Commission, dated October 28, 2013, pertaining to their concern’s
of the Veteran’s Memorial Park Lake.
Chair Breslin asked the clerk to contact the Conservation Commission and
ask the Conservation Commission to add a discussion with the IWC to the agenda for
their next meeting regarding the lake.

Discussion
with David Puzone, regarding 33 Deerfield Lane ,
development of property –
Tabled.
5.
185 Beacon Road , Discussion with Daniel Cusano regarding non-permitted barn
– Member Sullivan will draft letter to Mr. Cusano and submit to members for
review. Tabled.
6.
Continuation
of Show Cause Hearing regarding Town of Bethany
drainage repairs conducted in a regulated area without an Inland Wetlands
Permit – Chair Breslin will contact Diversified Technology
Consultants. Tabled.
7.
Update on
appeal submitted by James Woodward for 46 Mesa Drive – Tabled.
8.
Discussion in
regard to amendments to the Inland Wetlands Regulations per State of CT
– Commission members will discuss at the
November regular meeting and schedule a hearing for possibly January,
2014. Tabled.

members will meet at the Town Hall parking lot and proceed to Schilf Road,
Carmel Road and 54 Rainbow Road.
ADJOURNMENT
There being no further business to come before the
Commission, it was moved by Sullivan and seconded by Smith to adjourn the
regular meeting at 8:45 p.m. Unanimous
approval.
