The regular meeting of the Inland
Wetlands Commission was called to order at 7:33 p.m. in the Commission Meeting
Room in the Bethany Town Hall , 40 Peck Road , Bethany ,
Connecticut .
The following members of the Commission
were present:
Alexandra Breslin, Chair
Kristine Sullivan, Vice-Chair
Roger Hathaway, Member
The following members of the
Commission were absent:
Brian Smith, Member
Lisa Gaw, Member
Also present was:
Isabel Kearns, Inland Wetlands Enforcement Officer
NEW
BUSINESS
1. 63
Sargent Drive , Application #1223 submitted by Bill and Wendy Grieger to transfer
and modify IW Permit #1182 to construct
a storage building –
The Commission formally received the
application. Present to speak on behalf
of this application was Bill and Wendy Grieger, applicants and owners of
record.
Mr.
Grieger noted the following:
- The subject
property was previously approved by the Inland Wetlands Commission for a
larger building.
- Proposed
building will be smaller.
- Building
will be for storage.
- Received a
letter from the Quinnipiack Valley Health District dated June 16, 2014, approving
the design.
In
discussion, Commission members noted:
- Applicant would need permission from the original
permit holder to transfer permit.
- Applicant amended application for a new permit for
a Site Development from the Inland Wetlands Commission.
- Conditions of original IW Permit #1182 to be
included in new permit.
Further discussion and appropriate
action on the application was deferred until the Commission’s next regular
meeting on Monday, July 28, 2014. Tabled.
It was moved by Sullivan and seconded by
Hathaway to add to this evening’s agenda a discussion with Mr. and Mrs.
McKinney of 255 Bear Hill Road
pertaining to construction of garage. Unanimous approval.

Bear Hill Road - Discussion with Mr. and Mrs. McKinney regarding construction of
garage and possible removal of a man-made
pond
Present for this discussion were Paul and Judy
McKinney, property owners.
The McKinney ’s
noted the following:
- Would
like to locate a permanent garage.
- Concrete
slab already exists from 30 years ago.
In
discussion, Commission members noted:
- Property owner should ask
the building inspector to look at existing foundation and check with
current codes.
- Property owner will need
permit from the Inland Wetlands Commission.
- Property owner will need to
come back with application and plan showing where silt fence will be
located while constructing.
OLD BUSINESS
1.
1083 Amity
Road , Application #1222 submitted by Edward Rostowsky
for an
Inland Wetlands Permit to construct an
addition to the existing house –
The Commission formally received the application. Present to speak on behalf of this
application was Edward Rostowsky, applicant and owner of record.
Mr. Rostowsky revised the plan to address the Inland
Wetlands Commission comments from site visit on
Commission members discussed and proceeded to
deliberate.
It was moved
by Sullivan and seconded by Hathaway to approve Application #1222 submitted by
Edward Rostowsky for an Inland Wetlands Permit for an addition to the existing
house located at 1083 Amity Road in accordance with the submitted plan
entitled, “Proposed Addition” dated January 13, 2014, revised to June 23, 2014,
prepared by D’Amico Associates with hand-drawn revisions made by the applicant.
Based on the
installation and maintenance of the hay bales, there should be no adverse
impact to the downslope stream. Also, the removal of the material to be
excavated to another portion of the site away from the stream, there should not
be any adverse impact to the wetlands.
Vote 3 to 0.
Voting were:
Breslin, Sullivan, Hathaway.

Bethmour Road – rear lot, Discussion with John Paul Garcia –
Present for this discussion was John Paul Garcia,
P.E./L.S. representing the property owner.
Commission visited the site on June 1, 2014, and reviewed the original
subdivision plan. Mr. Garcia submitted revised plans dated to
June 10, 2014, for the Commission to review.
The Commission authorized the clerk to issue a letter to the Inland Wetlands
Commission that there is no action required from the Commission.
3. Discussion regarding Bethany West
clearing. (Letter from Roman Mrozinski
of the
Southwest Conservation District) – Tabled.
4.
185 Beacon
Road , Discussion with Daniel Cusano regarding
non-permitted barn –
Tabled.
5.
Continuation
of Show Cause Hearing regarding Town of Bethany
drainage repairs
conducted in a
regulated area without an Inland Wetlands Permit
– The IWEO is meeting with Diversified Technology Consultants as requested by
the Commission. Tabled.
6.
Discussion
in regard to amendments to the Inland Wetlands Regulations per State
of CT – Tabled.

seconded by Sullivan to approve, as submitted, the minutes of the May 18, 2014,
Special Meeting/Site Visit.

seconded by Sullivan to approve, as amended, the minutes of the May 19, 2014,
Special Meeting.

ENFORCEMENT
OFFICER REPORTS –
Member Sullivan mentioned the heavy water runoff
down Hilltop Road. The Commission asked
the IWEO to send a letter explaining to
Eric DeCesare of 37 Hilltop Road if he would do something to prevent the erosion
that is getting down into the State drainage from his property.
Also discussed was the lot one in from the corner of
Bethmour and Russell – part of the permit was to not to clear cut the lot. Property owners were supposed to maintain a
certain amount of vegetation. The
Commission asked the IWEO to copy the permit and send to property owners
stating the Commission has observed the trees being cleared.

There
being no further business to come before the Commission, it was moved by Sullivan
and
seconded by Hathaway to adjourn the regular meeting at 8:15 p.m.
