MINUTES OF THE BETHANY INLAND WETLANDS COMMISSION REGULAR MEETING OF MONDAY, DECEMBER 17, 2018                                            Page 1 of 5

 

The regular meeting of the Inland Wetland Commission was called to order at 7:30 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following members of the Commission were present:

         Kristine Sullivan, Chairman

         Rob Huxley, Member

         Nancy Scanlon, Member

         Charles Clark, Alternate Member, seated as a voting member

         James Nickle, Alternate Member, seated as a voting member

 

The following member of the Commission was absent:

         Roger Hathaway, Member

 

Also present was Isabel Kearns, Inland Wetlands Enforcement Officer

 

 

NEW BUSINESS 

 

No new business.

 

 

OLD BUSINESS

 

1)      Discussion and appropriate action on amended Cease and Desist Order, dated    November 13, 2018, amended on November 20, 2018, issued to Alan Green, Director of Bethany Public Works Department and Paul Crotta, Registered Agent, Mesa Construction Company for property located at Rural Old Mill Road South of Valley Road

 

Robert Huxley, Member, recused himself.

 

Chair Sullivan stated that at the last meeting the contractor was instructed to complete the placement of erosion controls.  No one has visited the site to check if this was completed.  The Commission would like to table this item to next month and will individually visit the site.

 

Further discussion and appropriate action on the application was deferred until the

Commission’s next regular meeting adjourned to Tuesday, January 22, 2019.  Tabled.

 

 

 

 

 

 

 

 

 

 

 

2)      Discussion and appropriate action on amended Cease and Desist Order, dated    November 13, 2018, amended on November 20, 2018, issued to Jamie Jarrett for the north side of the property located at 56 Downs Road

 

Present for this discussion for the property located at 56 Downs Road was Jamie Jarrett, owner of 56 Downs Road.

 

The Commission asked Ms. Jarret what she is proposing to do on the northern end of the property where stream is located.  Ms. Jarret stated she is not proposing anything in that area and submitted a plan showing the area she wants to clean up and install a fence. 

 

The Commission discussed the piles of material in the road area which have a potential of eroding into the stream.  The Commission would like Ms. Jarrett to level out the piles, push material away from the road and stabilize area.

 

It was moved by Clark and seconded by Huxley to rescind the Cease and Desist Order, dated November 13, 2018, amended on November 20, 2018, issued to Jamie Jarrett for the north side of the property located at 56 Downs Road subject to the area near the brook, as shown on the submitted map dated December 17, 2018, that is not to be disturbed and remain undisturbed.  If the property owner decides to cut any trees in this area, the property owner must come back to the Commission first so that the Commission can field check.  Also, any of the material that has been stocked piled on Brooks Road shall get pushed into the depressed area and area shall be seeded and hayed. 

Vote 5 to 0.

Voting for:  Sullivan, Huxley, Scanlon, Clark, Nickle.

Unanimous approval.

 

3)      Discussion with Susan March of 285 Sperry Road regarding location of shed for goats and the Farm Service Agency of the State of Connecticut  Tabled.

 

4)      OLD MILL ROAD, Application #1317 submitted by the Town of Bethany for an IW Permit for drainage and road improvements

Robert Huxley, Member, recused himself.

 

Commission members discussed and proceeded to deliberate.  It was moved by Clark and seconded by Scanlon to approve Application #1317 submitted by the Town of Bethany for an Inland Wetlands Permit for drainage and road improvements located at Old Mill Road as presented in the application, testimony and in accordance with the submitted site plan, untitled, prepared by Mesa Excavation and Paving, Inc., submitted on November 14, 2018, and including the standard conditions found on the Land Records, Volume 93, Page 802 and Page 803.

 

This approval is based on the fact that if the applicant follows the plan as shown there should be minimal or no adverse impact to the wetlands.

Vote 5 to 0.

Voting for:  Sullivan, Scanlon, Huxley, Clark, Nickle.

Unanimous approval.

 

 

 

 

 

5)      CARRINGTON ROAD (FROM VALLEY TO TUTTLE), Application #1318 submitted by Town of Bethany for an IW Permit for drainage improvements

 

Commission members discussed and proceeded to deliberate.  It was moved by Huxley and seconded by Scanlon to approve Application #1318 submitted by the Town of Bethany for an Inland Wetlands Permit for drainage improvements located at Carrington Road(From Valley to Tuttle) as presented in the application, testimony and in accordance with the submitted site plan, untitled, prepared by Mesa Excavation and Paving, Inc., submitted on November 14, 2018, and including the standard conditions found on the Land Records, Volume 93, Page 802 and Page 803.

 

This approval is based on the fact that if the applicant follows the plan as shown there should be minimal or no adverse impact to the wetlands.

Vote 5 to 0.

Voting for:  Sullivan, Scanlon, Huxley, Clark, Nickle.

Unanimous approval.

 

6)      Discussion and appropriate action on Bethany Inland Wetlands Commission Meeting Schedule for January 2019 – January 2020

 

Commission members discussed and proceeded to deliberate.  It was moved by Huxley and seconded by Scanlon to approve the Meeting Schedule for the Bethany Inland Wetlands Commission for January 2019 – January 2020 as submitted.

Voting for:  Sullivan, Scanlon, Huxley, Clark, Nickle.

Unanimous approval.

 

 

 

APPROVAL OF MINUTES

 

1)      It was moved by Huxley and seconded by Clark to approve, as submitted, the minutes of the November 20, 2018, Regular Meeting.

Voting for:  Sullivan, Huxley, Scanlon, Clark, Nickle.

Unanimous approval.

 

2)      It was moved by Clark and seconded by Scanlon to approve, as submitted, the minutes of the December 1, 2018, Special Meeting/Site Visit.

Huxley abstained.

Voting for:  Sullivan, Scanlon, Clark, Nickle.

BILL

 

1.      It was moved by Clark and seconded by Huxley to approve the portion of the invoice related to 68 Hopp Brook Road, for professional services rendered from September 30, 2018 to October 27, 2018, by Diversified Technology Consultants.  The portion of the invoice for Hilltop Road shall be referred to the Board of Selectman.

Voting for:  Sullivan, Huxley, Scanlon, Clark, Nickle.

Unanimous approval.

 

 

CORRESPONDENCE

 

1)      Letter from Isabel Kearns, IWEO, to Jamie Jarret of 56 Downs Road, dated December 3, 2018, Re:  Comments from IWC site walk at 56 Downs Road.

2)      Letter from Isabel Kearns, IWEO, to Jamie Jarret of 56 Downs Road, dated December 7, 2018, Re:  Attendance at the IWC Regular Meeting on December 17, 2018.

 

SCHEDULE SITE VISIT

None.

 

 

OTHER BUSINESS

Commission members briefly discussed the land for sale on Brooks Road at the Bethany/Hamden Town line and the States relation with the West Rock Ridge State Park Advisory Council for Bethany on land purchasing.

 

 

ADJOURNMENT

 

There being no further business to come before the Commission, it was moved by Scanlon and seconded by Huxley to adjourn the regular meeting at 8:14 p.m.
