MINUTES OF THE BETHANY PLANNING AND ZONING COMMISSION REGULAR MEETING OF WEDNESDAY, N
The regular meeting of the Planning and Zoning Commission was called to order at 7:03 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.
 
The following Commission Members were present:
            Kimberly McClure Brinton, Chairman
            Michael Calhoun, Member
            Donna Shea, Member
            Bradford Buchta, Alternate Member
Carol Lambiase, Alternate Member, seated as a voting member
            Eric McDonald, Alternate Member, seated as a voting member
 
The following Commission Members were absent:
            Michael Sullivan, Vice-Chairman
            Doug Goldner, Member
 
Also present was:
             Isabel Kearns, Zoning Enforcement Officer
 
 
APPROVAL OF MINUTES
            
  1. It was moved by Calhoun and seconded by Lambiase to approve the minutes of the October 5, 2016, Special Meeting/Site Visit/Hearing Continuation with the following correction:
  • Second paragraph – Add “Donna Shea” to Commission members who were present.
    Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.
Unanimous approval.
 
  1. It was moved by Calhoun and seconded by Lambiase to approve the minutes of the October 5, 2016, Regular Meeting with the following corrections:
  • Page 3, under Old Business, Item 1), second paragraph – Sentence reads “This is to help elevate adequate services to the residence in a timely fashion.” Change to “This is to help alleviate adequate services to the residence in a timely fashion.”
  • Page 5, last paragraph, first sentence – Sentence reads “Iron pins shall be located at all corners or angles the lots.” Change to “Iron pins shall be located at all corners or angles of the lots.”
    Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.
      Unanimous approval.
 
 
BILLS
 
  1. It was moved by McDonald and seconded by Calhoun to approve the payment of $1,200.00 (monthly pro rata basis), for services rendered for October 2016, by Hiram W. Peck III, AICP, Planning Consultant.
Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.
Unanimous approval.
 
 
 
  1. It was moved by Calhoun and seconded by McDonald to approve the payment of a bill for $325.00, dated for October 7, 2016, from Anne Sohon for transcript of public hearing on June 1, 2016, pertaining to 4 Peck Road.
    Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.
Unanimous approval.
 
  1. It was moved by Calhoun and seconded by Shea to approve the payment of a bill for $560.00, undated, from Pam Donnauro for transcript of public hearing on May 4, 2016, pertaining to 4 Peck Road.
    Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.
Unanimous approval.
 
 
GENERAL CORRESPONDENCE
 
  1. Letter from Bruce Loomis, Chairman of Conservation Commission, dated October 13, 2016, Re:  PZC decision on Application #2016-013, 591 Amity Road.
  2. Letter from Dick Margulis, President of Green Haven, Inc., dated October 13, 2016, Re:  Conditions of Zoning Approval for Green Haven, Inc. for Rocky Corner Cohousing.

NEW BUSINESS
 
  1. Discussion with Bill Grieger pertaining to transfer of permits for 12 Pleasant Drive
 
Present for this discussion were Bill and Wendy Grieger, owners of record of 12 Pleasant Drive.  Mr. Grieger stated they purchased the property at 12 Pleasant Drive and would like to transfer the permits to his name.  Mr. Grieger submitted a letter, dated November 2, 2016, regarding a request to transfer the approval on this property to Bethany Heavy Equipment and Storage.
 
It was moved by Calhoun and seconded by Lambiase to accept the letter from Bill and Wendy Grieger, dated November 2, 2016, to transfer Permit #2015-007 and #2015-008 for 12 Pleasant Drive approved on July 1, 2015, to Bill and Wendy Grieger, owners of record.
Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.

  1. 172 Carrington Road, Application #2016-017 submitted by Whitney Miller-Caporaso for a Home Occupation Permit – Naturopathic Physician Office and Free-standing sign
 
The Commission formally received the application.  Present to speak on behalf of this application was Whitney Miller-Caporaso, applicant.
 
Ms. Caporaso briefly reviewed the proposed project.
 
Some items noted by Commission members were:
  • Applicant amended application to include a freestanding sign.
  • No comment letter from South Central Connecticut Regional Water Authority.
 
Further discussion and appropriate action on the application was deferred until the Commission’s Special Meeting scheduled for November 17, 2016.  Tabled.
 
 
  1. 153 Amity Road, Application #2016-018 submitted by Mark Sette for a Special Exception Permit to create a dwelling unit with the storage building
 
The Commission formally received the application.  No one was present.
 
The Commission scheduled a public hearing date of Wednesday, December 7, 2016, at the Regular Meeting.
 
Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Wednesday, December 7, 2016.  Tabled.
 
 
  1. 153 Amity Road, Application #2016-019 submitted by Mark Sette for a Site Plan Approval for 2 Storage Buildings and a Free-standing Sign
 
The Commission formally received the application.  No one was present.

  1. 696 Amity Road, Unit A-9, Application #2016-016 submitted by Keyur Patel for a Change of Use to liquor store
     
    Isabel Kearns, ZEO, stated the applicant will be withdrawing the application.  Tabled.
     
     
  2. Proposed amendment to Section 7 – Signs and Parking & Loading Regulations – to add Subsection  7.3.1 – Special Exception for lighted signs in the B&I Zone - Public hearing scheduled for December 7, 2016
     
    The Commission will meet at a Special Meeting on November 17, 2016, at 7:00 p.m. to discuss this item before public hearing.  Tabled.
     
  3. Discuss future Land Use Plan (possible insertion in Town Plan of Conservation & Development)Tabled.
     
  4. Discussion regarding the rewriting of the current Zoning Regulations
 
The Commission will meet at a Special Meeting on November 17, 2016, at 7:00 p.m. to discuss the draft submitted by Hiram Peck on October 5, 2016.  Tabled.
 
 
 
 
 
 
 
ZONING ENFORCEMENT OFFICER’S REPORT
Isabel Kearns, ZEO, reported on the following:       
  • Submitted report on Building Permits dated November 2, 2016.
  • 10 Round Hill Road, Ciola – No building permits issued.  ZEO will follow-up.
  • Meyers Road, Green Haven – Submitted building permits.  Working with QVHD.
    Will be meeting with QVHD with Building Department, First Selectwoman and ZEO.

It was moved by Calhoun and seconded by McDonald to adjourn the regular meeting at        7:45 p.m.
