The regular meeting of the Inland Wetland Commission was called to
order at 7:33 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40
Peck Road, Bethany, Connecticut.
The following members of the Commission were present:
Kristine Sullivan, Chairman
Nancy Scanlon, Member
Charles Clark, Alternate Member, seated as a
voting member
James Nickle, Alternate Member, seated as a
voting member
The following members of the Commission were excused:

Also present was Isabel Kearns, Inland Wetlands Enforcement Officer
NEW BUSINESS
No new business.
OLD BUSINESS
1)
43 and 51
Russell Road, Application #1321 submitted by Hop Brook Storage for an Inland
Wetlands Permit for outdoor storage of new portable toilets on existing
driveway
–
Present to speak
on behalf of this application were Bill and Wendy Grieger, owners of
record.
Chair Sullivan
mentioned that the Commission conducted a site inspection on Saturday, June 1, 2019.
Chair Sullivan
stated there was a concern that the property owners were doing maintenance on
upper driveway and parking area in an email dated June 17, 2019, and that she
(Chair Sullivan) visited the site and did not see anything that would require
an Inland Wetlands Permit.
Also, Chair
Sullivan read the email from John Laudano, Quinnipiack Valley Health Department
Representative, dated May 22, 2019, in regard to Mr. Marinko’s well concern at
55 Russell Road, regarding the portable toilets.
Commission
members discussed the application for the outside storage of the portable
toilets on existing driveway and proceeded to deliberate.
It was moved by Clark
and seconded by Scanlon to approve Application #1321 submitted by Hop Brook
Storage for an Inland Wetlands Permit for outdoor storage of new portable
toilets on the existing driveway located at 43/51 Russell Road as presented in
the application, testimony and in accordance with the submitted plan, untitled,
submission dated May 20, 2019, prepared by the applicants. Also, this approval is subject to the standard
conditions found on the Land Records Volume 93, Page 802 and Page 803.
This
approval is based on the fact that if the portable toilets are located as shown
on the approved site plan, there should be minimal or no adverse impact to the
onsite wetlands.
Vote 3 to 0.
Voting for: Sullivan, Scanlon, Clark, Nickle.
Unanimous approval.

Cause Hearing pertaining to Cease and Desist Order, dated April 13, 2019, issued to Lizbeth Kelley
for property located at 42 Deerfield Lane, prepared by Isabel Kearns, Inland
Wetlands Enforcement Officer in regard to earth material introduced to property –
Chair Sullivan
mentioned the Inland Wetlands Commission conducted a site visit on Saturday,
June 1, 2019. Also, Chair Sullivan
mentioned the Kelley’s’ are on vacation and the Show Cause Hearing will be
continued to the next regular meeting scheduled for Monday, July 15, 2019, at
which the Kelley’s will have their contractor present for the meeting.

OTHER BUSINESS
The Commission
discussed the erosion controls located at Meyers Road, the Rocky Corner
Project, the entrance onto Meyers Road, and that the silt fence was swinging in
the breeze, erosion on both sides, log cabin across road was receiving muddy
water in pond, and no anti tracking pad.
Isabel Kearns, IWEO, stated they have placed stone and silt fence. Chair Sullivan asked Ms. Kearns to visit the
site once a week to check the erosion controls.

seconded by Clark to approve, as amended, the minutes of the May 20, 2019,
Regular Meeting.

It was moved by Scanlon and seconded by Clark
to approve, as submitted the minutes of the June 1, 2019, Special Meeting/Site
Visit.
Voting for: Sullivan, Scanlon, Clark, Nickle.
Unanimous approval.

There
being no further business to come before the Commission, it was moved by Clark
and seconded by Scanlon to adjourn the regular meeting at 8:15 p.m.
