The regular meeting of the Inland
Wetlands Commission was called to order at
7:35 p.m. in the Commission
Meeting Room of the Bethany Town Hall ,
40 Peck Road , Bethany ,
Connecticut .
The following members of the Commission
were present:
Alexandra Breslin, Chair
Kristine Sullivan, Vice-Chair

The following member of the

OLD BUSINESS
1. Schaffer Road
(east to west portion), Application #1214 submitted by the Town of Bethany for
an Inland Wetlands Permit to widen and reclaim road and replace or repair
existing drainage – No one was present to speak on
behalf of this application.
Reviewed new plan that was submitted by paul. Representing mr. green.

The Commission visited the site on February 2, 2014.
The Commission noted the following:

Heavy water flow on the north
side of Schaffer Road .
·
Would like the applicant to
furnish additional details on proposed riprap.
·
On the north side of Schaffer Road , the
catch basins exit into a swale and there is a lot of scouring. Need more intense area of control of the
water to keep it from scouring.
·
Applicant is showing a riprap
plunge pool on plan; will that be sufficient.
Further discussion and appropriate
action on the application was deferred until the Commission’s next regular
meeting on Monday, March 24, 2014. Tabled.
2. Lebanon Road
(between 8 and 22 Lebanon Road), Application #1215 submitted by the Town of
Bethany for an Inland Wetlands Permit to extend shoulders on road and filling
of side slopes with bank-run gravel then cover with 12” and 18” of wood chips
for erosion controls and to allow natural vegetation to regrow

The Commission visited the site on February 2, 2014.
The Commission noted the following:
- The
road was created prior to wetlands and therefore, crosses a wetland.
- Very
steep slope and concerned that the proposed filling is not going to solve
the problem of erosion.
- Asked
Diversified Technology Consultants to review.
Further discussion and appropriate
action on the application was deferred until the Commission’s next regular
meeting on Monday, March 24, 2014. Tabled.
6. 24 Dayton Road, Application #1216
submitted by Scott Farquharson for an IW Permit to construct a 24-foot by
29-foot and 5-inches garage and addition above –
The Commission formally received the
application. Present to speak on behalf
of this application was Scott Farquharson, representing the owners.

Farquharson noted the following:
- He will be constructing a garage addition with
a second floor above which will be attached to the existing home.
- Will be installing silt fencing during
construction so there will be no impact to the wetlands.
- This project is not encroaching the wetlands.
In
discussion, Commission members noted:
- Would like to visit the site.
- Asked the builder to place stakes where end of
addition would be located.

Lane , Application #1217 submitted by Vincent Franco for
an Inland Wetlands Permit to locate and attached garage with furnace and room
above garage –
One big boulder that they should push back.
Isable important that you field check this before
and during construction.

present for this discussion. Tabled.

regarding non-permitted barn – will send copy of pics and say we noticed you

visited the site on February 2, 2014, and took pictures. The Commission noted that they did not see
any new disturbance at rear lot (187 Beacon Road – Gaetano is all site) just
old silt fence but did notice that at 185 Beacon Road (Cusano) there was a
payloader and debris was being pushed into the wetlands. Tabled.

of Show Cause Hearing regarding Town of Bethany
drainage repairs
conducted in a regulated area without an
Inland Wetlands Permit – Tabled.

on appeal submitted by James Woodward for 46 Mesa

the public hearing continuation on the subject application. Chair Breslin read the notice prepared for
the public hearing. Chair Breslin
briefly reviewed the process of the public hearing and introduced the
Commission members and staff.

Smith stated that the plans will be revised due to comments from the Fire
Marshal, Bethany Volunteer Fire Department, Nafis & Young and Regional
Water Authority and he suggested continuing the public hearing.
Attorney
Smith then turned the presentation over to Thomas Daly, P.E. and Principal of
Milone & MacBroom, who reviewed the revisions to the plans. Some areas Mr. Daly touched on are as
follows:
·
Wells
are being moved to a different location from working with the Regional Water
Authority.
·
Working
with the Fire Marshal and Bethany Volunteer Fire Department and will provide a
secondary accessway from Meyers Road.
·
Reducing
main driveway down to 22 feet in width.
·
Rear
driveway adding little bump outs to parking area.
·
Septic
system being moved due to well relocation and will have to resubmit to
Quinnipiack Valley Health District for approval.
·
Relocating
water tank.
·
Addressed
issue with ponds and mosquitoes.
Andy
Bevilacqua of Diversified Technology Consultants was present. Mr. Bevilacqua reviewed his letter dated
January 2, 2014, in response to his review of the plans and report provided by
the Developer’s Engineer. Mr.
Bevilacqua stated all his major concerns on the project have been addressed but
he will have to review the revised plans when available.
Some
items mentioned from the Commission members were:

Maintenance
schedule for the detention basins.
·
Propose
a bond and itemize what the bond will cover so that DTC can review.
Mr.
Bevilacqua mentioned that if the developer half way through construction walks
away, the Town needs money to restore the site.
Attorney
Smith mentioned that at the last public hearing the Inland Wetlands Commission
wanted the record of the Halter Estates Wetlands application incorporated into
this hearing record. Attorney Smith
stated that this application stands on its own.
If there is anything in that particular record that you would like to
have addressed, please let us know so that we can address.
Chair
Breslin asked if there was anyone from the audience that would like to
comment. No one commented.
Attorney
McSherry mentioned in regard to the yearly maintenance the applicant may
consider putting this in the bylaws of the Association and require them to have
a capitol account.
Chair
Breslin made a disclosure on the hearing record again that she serves the Town
as a member of the South Central Connecticut Regional Water Authority Policy
Board.
Chair
Breslin stated that she has asked the Inland Wetlands Commission Members to
submit a paragraph or resume stating their qualifications. Brian Smith submitted a sheet with his
experience information.
Member
Sullivan mentioned she received a call from Tom Cavaliere (the seller’s
attorney) this afternoon regarding the application and she did not speak to
him.
Attorney
Smith submitted consent to extension of time to continue the public hearing
to March 26, 2014.
ADJOURNMENT
There being no further business to come
before the Commission, it was moved by Smith
and
seconded by Sullivan to adjourn the regular meeting at 8:50. Unanimous
approval.
