MINUTES OF THE BETHANY PLANNING AND ZONING COMMISSION REGULAR MEETING OF WEDNESDAY, JULY 2, 2014                                                    Page 1 of 10

 

The regular meeting of the Planning and Zoning Commission was called to order at 7:04 p.m. in the Commission Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following Commission Members were present:

            Kimberly McClure Brinton, Chairman

APPROVAL OF MINUTES

            

1.      It was moved by Gugliotti and seconded by Calhoun to approve, as submitted, the minutes of the June 4, 2014, Regular Meeting.

      Voting for:  Brinton, Calhoun, Sullivan, Shea, Gugliotti.

      Unanimous approval.

 

 

BILLS

 

1.      It was moved by Calhoun and seconded by Gugliotti to approve the payment of $1,000.00 (monthly pro rata basis), for services rendered for June 2014, by Hiram W. Peck III, AICP, Planning Consultant.

      Voting for:  Brinton, Calhoun, Sullivan, Shea, Gugliotti.

Unanimous approval.

Isabel Kearns, ZEO, reported on the following.

·         Submitted memo from Hiram Peck, Planning Consultant, dated May 21, 2014, Re:  Application review fees for Planning and Zoning Applications.

 

 

PUBLIC HEARING

 

·         378 Bethmour Road, Application #2014-020 submitted by Donald Parrott for a Special Exception Permit for one rear lot and Application #2014-022 for a Two-lot Resubdivision

 

At 7:18 p.m., Chair Brinton read the call for the public hearing.  Chair Brinton reviewed the complete application files.

 

Chair Brinton read the list of correspondence that has been received as follows:

·         Memo from Isabel Kearns, ZEO, dated June 6, 2014, Re:  Comments on review of 378 Bethmour Road (Resubdivision and Special Exception Rear Lot.)

·         Letter from Bruce Loomis, Chairman of the Conservation Commission, submitted June 20, 2014, Re:  Comments on review of plans for 378 Bethmour Road.

Present to speak on behalf of this application was John Paul Garcia, L.S./P.E. representing the applicant.  Mr. Garcia briefly reviewed the proposed project and some items noted were:

  • These application will create two conforming building lots.
  • Requested a waiver for a water source for fire protection.
  • Requested a waiver for open space.
  • There will be no new construction.
  • No wetlands on the property and there are no issues with the Inland Wetlands Commission.

 

Isabel Kearns, ZEO, mentioned the removal of the shed on Lot 2 and possibly the removal of the accessway to the shed.  This would change the coverage percentages and should be shown on plan before the filing of the mylar.

 

Hiram Peck, Planning Consultant, questioned the letter from the Quinnipiack Valley Health District, dated June 25, 2014.

 

Chair Brinton asked if anyone from the public would like to speak for the application or against the application.  There were no comments.

 

At 7:34 p.m., it was moved by Calhoun and seconded by Sullivan to close the public hearing on the subject application.

 

 

NEW BUSINESS

 

1.      87 Old Amity Road, Application #2014-023 submitted by Brendan Rieger for a Change Of Use to a music studio and rehearsal space

 

The Commission formally received the application.  Present to speak on behalf of this application was Brendan Rieger, applicant.

 

Member Calhoun, Gugliotti and Sullivan stated that they knew the applicant but could speak objectively for the health and safety of the Town.

 

Mr. Grieger noted the following:

·         Parking plan shows 47 parking spaces.

·         Hours of operation would be in the evening.

·         Events would take place once a month or every other month.

·         Some events would be benefits for bands.

·         Some events would be students from high school.

·         When event taking place there would be one person in parking lot, one at door and two people inside to keep order.

·         There will be five employees.

 

Some Commission members noted the following:

  • Abandoned vehicles on property.
  • Applicant has ideas of cleaning property.
  • Exterior lighting – existing.
  • Quinnipiack Valley Health District has signed off on the septic system
  • Not sure what the zoning regulations state about a music venue.
  • Questioned the entrance off of Amity Road.
  • Applicant not proposing anything to sound proof building.

 

Hiram Peck, Planning Consultant, stated details need to be clearer regarding people bringing food and drink, enough parking, other businesses parking on the same property and other permits on the property.

 

The Commission scheduled a public hearing date of August 6, 2014.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting on Wednesday, August 6, 2014.  Tabled.

 

 

2.      Discussion with Anthony Vallillo regarding the Jonia Court Subdivision – 788 Amity Road  Forward letter from Anthony Vallillo, owner of 788 Amity Road, dated June 10, 2014, Re:  788 Amity Road, Fire Suppression Water Tank to the Fire Marshal.  Tabled.

 

 

3.      696 Amity Road, Units 5 and 6, Application #2014-024 submitted by Orlando Skaarva for a Change of Use to a convenience store

 

The Commission formally received the application.  No one was present to speak on behalf of this application.

 

Isabel Kearns, ZEO, stated the Commission did not receive approval from the Quinnipiack Valley Health Department.

4.      980 Amity Road, Application #2014-025 submitted by Frances Doba for a Special Exception for an Accessory Apartment

 

The Commission formally received the application.  No one was present to speak on behalf of this application.

5.      90 Pole Hill Road, Application #2014-026 submitted by Bethany Community Garden Club to build a community garden

 

The Commission formally received the application.  Present to speak on behalf of this application was Mary Ellen Unger, Chairman of the Bethany Community Garden Club.         Mrs. Unger distributed packets with information to each member. 

 

Hiram Peck, Planning Consultant, stated this would be a Special Exception and a Section 8-24 Review.  The Commission scheduled a public hearing date of August 6, 2014.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting on Wednesday, August 6, 2014.  Tabled.

 

 

6.      To take place at end of meeting – Executive Session to discuss litigation matters.

 

 

OLD BUSINESS

 

1.      63 Sargent Drive, Application #2014-021 submitted by Bill and Wendy Grieger for a Site Plan for storage building

 

Present to speak on behalf of this application was Bill Grieger, applicant and owner of record.

 

Isabel Kearns, ZEO, stated that the Planning and Zoning Commission can’t act on this application because the Inland Wetlands Commission has not acted on the application to date.

 

Mr. Grieger submitted plans.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting on Wednesday, August 6, 2014.  Tabled.

 

 

 

It was moved by Sullivan and seconded by Calhoun to add the two applications for                  378 Bethmour Road to Old Business.  Unanimous approval.

 

2.      378 Bethmour Road, Application #2014-020 submitted by Donald Parrott for a Special Exception Permit for one rear lot

 

Isabel Kearns, ZEO, prepared a draft resolution.  Commission members discussed and proceeded to deliberate.

 

It was moved by Calhoun and seconded by Sullivan to approve the following resolution for Application #2014-020:

 

Whereas, Donald Parrott and Lisa Miles, owners of the property, applied to the Bethany Planning and Zoning Commission for a Special Exception Rear Lot (Application #2014-020) to be held together with a Two-lot Resubdivision (Application #2014-022) for property located at 378 Bethmour Road on June 4, 2014;

 

Whereas, Donald Parrott authorized John Paul Garcia to act on his behalf in a letter to the Planning and Zoning Commission dated May 27, 2014;

 

Whereas, the Commission, at its regular meeting held on June 4, 2014, scheduled a public hearing for July 2, 2014, for this Special Exception Rear Lot located at 378 Bethmour Road to be held in conjunction with the Two-Lot Resubdivision also of 378 Bethmour Road;

 

Whereas, the Commission opened the public hearing for the Special Exception Rear Lot and the Two-lot Resubdivision of 378 Bethmour Road on July 2, 2014, and closed it at the conclusion of testimony that same evening;

 

Now Therefore, the Commission makes the following findings of fact and decision regarding the application:

 

1)                  The parcel consists of 5.635 acres and is located in the R-65 Zone.

2)                  The parcel is not located in a public water supply watershed area.

3)                  The Planning and Zoning Commission received a letter dated June 25, 2014, from Lynn Fox and Leslie Balch of Quinnipiack Valley Health District stating that both lots contain existing dwellings with existing private subsurface sewage disposal systems. Detected soil conditions in areas designated for eventual replacement of each subsurface sewage disposal system indicate that the minimum requirements of the appropriate sections of the Connecticut Public Health Code were observed.

4)                  The Planning and Zoning Commission received a letter dated June 27, 2014 from the Inland Wetlands Commission in which they state the activity will have no adverse impact on any wetlands or watercourses; therefore, no Inland Wetlands permit is required.

5)                  Roderick White, Fire Marshal, signed off on the back of the application on June 24, 2014 indicating his approval.

6)                  Michael Katzmark, Bethany Volunteer Fire Department  Water Source Officer signed off on the back of the application form on June 30, 2014, indicating his approval.

 

Now Therefore Be It Resolved, that pursuant to the Subdivision Regulations of the Town of Bethany (Section 10) effective to July 16, 2007 and the Zoning Regulations of the Town of Bethany (Section 4.4H), effective to January 1, 2012, Application #2014-020 for a Special Exception Rear Lot which is approved (in conjunction with the Two-lot Resubdivision of 378 Bethmour Road), as shown on the following plans prepared by John Paul Garcia & Associates, Bethany, Connecticut:

a)      “Resubdivision Map”, dated April 8, 2014, revised to June 10, 2014, Drawing        No. C-1.

b)      “Site Development Plan”, dated April 8, 2014, revised to June 10, 2014, Drawing No. C-2.

 

And with the following modifications:

 

1)      The plans shall be amended to include a turnoff for emergency vehicles for the new accessway to Lot 2.  Said driveway shall be installed by the applicant and approved by the Town prior to the filing of the mylar.

      Vote:  5 to 0.

      Voting for:  Brinton, Calhoun, Sullivan, Shea, Gugliotti.

      Unanimous approval.

 

 

3.      378 Bethmour Road, Application #2014-022 submitted by Donald Parrott for a Two-lot Resubdivision

 

Isabel Kearns, ZEO, prepared a draft resolution.  Commission members discussed and proceeded to deliberate.

 

It was moved by Calhoun and seconded by Sullivan to approve the following resolution for Application #2014-022:

 

Requested Waivers:

 

1)                  Waiver of Open Space.  The application reflects that a waiver of open space has been requested under Section 11.4 of the Town of Bethany Subdivision Regulations.  As the property is already developed, there is no opportunity to obtain any open space.  The Conservation Commission submitted a letter which was received on June 20, 2014, in which it states that they have no objection to its approval, including a waiver of the open space. The request for a waiver of open space is hereby granted.

2)                  Waiver of Fire Suppression Water Source:  The application reflects that a waiver of the fire suppression water source has been requested under Section 11.5 of the Town of Bethany Zoning Regulations. 

 

Whereas, Donald Parrott and Lisa Miles, owners of the property, applied to the Bethany Planning and Zoning Commission on June 4, 2014, for a Two-lot Resubdivision of                  378 Bethmour Road (Application #2014-022) to be held in conjunction with a Special Exception Rear Lot (Application #2014-020);

a)      “Resubdivision Map”, dated April 8, 2014, revised to June 10, 2014, Drawing        No. C-1.

b)      “Site Development Plan”, dated April 8, 2014, revised to June 10, 2014, Drawing No. C-2.

 

And with the following modifications:

1)     The driveway maintenance easement for the septic system must be reviewed and approved by Town Counsel.  Upon his approval, it shall be filed on the land records in the Town Clerk’s office along with the mylar of the record resubdivision plan.

2)     The construction of the new driveway serving Lot 2 shall be completed by the applicant and approved by the Town prior to the filing of the mylar.

3)     The 820 square foot shed located on Lot 2 shall be removed prior to the filing of the mylar.

4)     All iron pins shall be placed as shown on the resubdivision plan prior to the filing of a mylar.

5)     A new deed and description shall be created for both lots and shall be filed along with the mylar.

6)     The building and ground coverage percentages will change with the removal of the shed on Lot 2 and possibly with the removal of the accessway to the shed (if it is currently impervious).  So the coverage percentages in the zoning table should reflect the removal of the shed and possibly the accessway.

Vote:  5 to 0.

Voting for:  Brinton, Calhoun, Sullivan, Shea, Gugliotti.

Unanimous approval.

 

 

4.      Discussion with Marc D’Andrea  regarding outside storage at 860 Carrington Road

 

Mr. D’Andrea was not present.  Isabel Kearns, ZEO, stated that she has had contact with         Mr. D’Andrea.  Ms. Kearns stated that Mr. D’Andrea showed her the area he needs for his business for outside storage but he will still be in violation.

 

Hiram Peck, Planning Consultant, suggested that Ms. Kearns visit the site and measure the subject area with a tape measure.  The ZEO to report back to the Commission at the next regular meeting.  Tabled.

 

 

5.      Continue discussion and possible action to set public hearing date regarding proposed amendments to the Zoning Regulations on accessory buildings, signage for larger parcels, home occupation permits, etc.  – A public hearing was scheduled for September 3, 2014.  Tabled.

 

6.      Continue discussion on Village Districts  - Hiram Peck, Planning Consultant, mentioned there is a grant opportunity to create Village Districts and that he would write the grant.  Tabled.

 

 

OTHER BUSINESS

 

Complaint against 48 Northrop Road – Cheryl Vernik of 44 Northrop Road stated she came to meeting again to find out if the complaint her and her husband mentioned at the previous meeting regarding the illegal storage of cars on the property was being addressed.

 

Isabel Kearns, ZEO, stated she called the DMV but did not hear back from them.  The ZEO mentioned she felt the fencing solved the issue.

 

Mrs. Vernik stated there is still an issue with the cars being visible from her property (44 Northrop Road) and that the ZEO can come and walk her property to see for herself.               Mrs. Vernik also stated that the Quinnipiack Valley Health District sited the property owners of 48 Northrop Road for the improper storage of the horse manure and had them bring in a storage container.

 

The Zoning Enforcement Officer will investigate further.  Tabled.

 

 

Executive Session to discuss litigation matters

 

At 9:00 p.m., it was moved by Calhoun and seconded by Sullivan for the Commission to enter into an executive session, inviting Hiram Peck, Planning Consultant to join in that executive session.  Unanimous approval.

 

At 9:35 p.m., it was moved by Calhoun and seconded by Sullivan for the Commission to exit out of the executive session.  Unanimous approval.

 

 

There being no further business to come before the Commission, it was moved by Calhoun and seconded by Gugliotti to adjourn the regular meeting at 9:36 p.m.  Unanimous approval.

The regular meeting of the Inland Wetlands Commission was called to order at 7:33 p.m. in the Commission Meeting Room in the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following members of the Commission were present:

         Alexandra Breslin, Chair

         Kristine Sullivan, Vice-Chair

         Roger Hathaway, Member

 

The following members of the Commission were absent:

         Brian Smith, Member

         Lisa Gaw, Member

 

Also present was:

         Isabel Kearns, Inland Wetlands Enforcement Officer

 

 

NEW BUSINESS

 

1.  63 Sargent Drive, Application #1223 submitted by Bill and Wendy Grieger to transfer

     and modify IW Permit #1182 to construct a storage building

 

The Commission formally received the application.  Present to speak on behalf of this application was Bill and Wendy Grieger, applicants and owners of record.

 

Mr. Grieger noted the following:

  • The subject property was previously approved by the Inland Wetlands Commission for a larger building.
  • Proposed building will be smaller.
  • Building will be for storage.
  • Received a letter from the Quinnipiack Valley Health District dated June 16, 2014, approving the design.

 

In discussion, Commission members noted:

  • Applicant would need permission from the original permit holder to transfer permit.
  • Applicant amended application for a new permit for a Site Development from the Inland Wetlands Commission.
  • Conditions of original IW Permit #1182 to be included in new permit.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting on Monday, July 28, 2014.  Tabled.

 

 

 

 

 

 

It was moved by Sullivan and seconded by Hathaway to add to this evening’s agenda a discussion with Mr. and Mrs. McKinney of 255 Bear Hill Road pertaining to construction of garage.  Unanimous approval.

 

 

2.  255 Bear Hill Road - Discussion with Mr. and Mrs. McKinney regarding construction of

     garage and possible removal of a man-made pond

 

Present for this discussion were Paul and Judy McKinney, property owners.

 

The McKinney’s noted the following:

  • Would like to locate a permanent garage.
  • Concrete slab already exists from 30 years ago.

 

In discussion, Commission members noted:

  • Property owner should ask the building inspector to look at existing foundation and check with current codes.
  • Property owner will need permit from the Inland Wetlands Commission.
  • Property owner will need to come back with application and plan showing where silt fence will be located while constructing.

 

 

OLD BUSINESS

 

1.      1083 Amity Road, Application #1222 submitted by Edward Rostowsky for an

      Inland Wetlands Permit to construct an addition to the existing house

 

The Commission formally received the application.  Present to speak on behalf of this application was Edward Rostowsky, applicant and owner of record.

 

Mr. Rostowsky revised the plan to address the Inland Wetlands Commission comments from site visit on

 

Commission members discussed and proceeded to deliberate.

 

It was moved by Sullivan and seconded by Hathaway to approve Application #1222 submitted by Edward Rostowsky for an Inland Wetlands Permit for an addition to the existing house located at 1083 Amity Road in accordance with the submitted plan entitled, “Proposed Addition” dated January 13, 2014, revised to June 23, 2014, prepared by D’Amico Associates with hand-drawn revisions made by the applicant.

 

 

 

 

 

Based on the installation and maintenance of the hay bales, there should be no adverse impact to the downslope stream. Also, the removal of the material to be excavated to another portion of the site away from the stream, there should not be any adverse impact to the wetlands.

Vote 3 to 0.

Voting were:  Breslin, Sullivan, Hathaway.

Unanimous approval.

 

 

2.  378 Bethmour Road – rear lot, Discussion with John Paul Garcia

 

Present for this discussion was John Paul Garcia, P.E./L.S. representing the property owner.    Commission visited the site on June 1, 2014, and reviewed the original subdivision plan.         Mr. Garcia submitted revised plans dated to June 10, 2014, for the Commission to review.  The Commission authorized the clerk to issue a letter to the Inland Wetlands Commission that there is no action required from the Commission.

 

3.  Discussion regarding Bethany West clearing.  (Letter from Roman Mrozinski of the

     Southwest Conservation District)Tabled.

 

4.      185 Beacon Road, Discussion with Daniel Cusano regarding non-permitted barn

Tabled.

 

5.      Continuation of Show Cause Hearing regarding Town of Bethany drainage repairs

conducted in a regulated area without an Inland Wetlands Permit – The IWEO is meeting with Diversified Technology Consultants as requested by the Commission.  Tabled.

 

6.      Discussion in regard to amendments to the Inland Wetlands Regulations per State

      of CT  Tabled.

1.      Letter from Quinnipiack Valley Health District, dated June 16, 2014, Re:  Comments on review of application for 63 Sargent Drive.

2.      Letter from Isabel Kearns, IWEO, to Brian Ferraro of 30 Green Hill Road, dated June 17, 2014, Re:  Notice of Violation – earth material from property is eroding onto Green Hill Road.

ENFORCEMENT OFFICER REPORTS

 

Member Sullivan mentioned the heavy water runoff down Hilltop Road.  The Commission asked the  IWEO to send a letter explaining to Eric DeCesare of 37 Hilltop Road if he would do something to prevent the erosion that is getting down into the State drainage from his property.

 

Also discussed was the lot one in from the corner of Bethmour and Russell – part of the permit was to not to clear cut the lot.  Property owners were supposed to maintain a certain amount of vegetation.  The Commission asked the IWEO to copy the permit and send to property owners stating the Commission has observed the trees being cleared.
