MINUTES OF THE BETHANY PLANNING AND ZONING COMMISSION REGULAR MEETING OF WEDNESDAY, AUGUST 5, 2015                Page 1 of 9

The regular meeting of the Planning and Zoning Commission was called to order at 7:02 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following Commission Members were present:

            Kimberly McClure Brinton, Chairman

APPOINTMENT OF STAFF -  Tabled.

 

 

APPROVAL OF MINUTES

            

1.      It was moved by Sullivan and seconded by Calhoun to approve the minutes of the July 1, 2015, Regular Meeting, with the following amendment:

·         Page 4, Second Paragraph, First Bullet – Reads “Cheryl Petruzzello of 648 Amity Road – asked question on what type of trucks going to be stored in proposed building.”  Change to “Cheryl Petruzzello of 648 Amity Road – asked question on what type of trucks are going to be stored in proposed building.”

     Voting for:  Brinton, Sullivan, Calhoun, Shea, Buchta.

     Goldner abstained.

     Unanimous approval.

 

 

BILLS

 

1.      It was moved by Sullivan and seconded by Calhoun to approve the payment of $1,200.00 (monthly pro rata basis), for services rendered for June 2015, by Hiram W. Peck III, AICP, Planning Consultant.

Voting for:  Brinton, Sullivan, Calhoun, Goldner, Shea.

Unanimous approval.

 

2.      It was moved by Calhoun and seconded by Sullivan to approve the payment of $1,200.00 (monthly pro rata basis), for services rendered for July 2015, by Hiram W. Peck III, AICP, Planning Consultant.

Voting for:  Brinton, Sullivan, Calhoun, Goldner, Shea.

Unanimous approval.

 

 

3.      It was moved by Calhoun and seconded by Sullivan to approve the payment of $105.00 for recording services rendered at the public hearing held on August 5, 2015,                (73 Carrington Road) by Anne Sohon.

ZONING ENFORCEMENT OFFICER’S REPORT

 

Isabel Kearns, ZEO, reported on the following:       

·         Submitted report on Building Permits dated August 5, 2015.

·         788 Amity Road – Zoning Inquiry regarding amount of dogs at facility and hours when dogs are kept outside.  I was contacted by Meredith Vallillo and was told she only has 25 dogs on property and they are following hours allowed for dogs outside at facility.

·         Discussed excessive signage on Route 63 for businesses and some signs in State right-of-way.  Hiram Peck will research and get more information back to the Commission.

 

 

PUBLIC HEARING

 

·         73 Carrington Road, Application #2015-011 submitted by Carol and Darrell Merchant for a Special Exception Permit for an Accessory Apartment

 

At 7:23 p.m., Chair Brinton called the public hearing to order.   Roll call was taken.        Chair Brinton read the legal notice for the public hearing.  Chair Brinton reviewed the complete application file.

 

Isabel Kearns, ZEO, stated the applicants are asking to have an in-law apartment and that they meet all the regulation requirements and have received all department signoffs.

 

Present for the public hearing was Darrell Merchant, applicant and owner of record.

 

Hiram Peck, Planning Consultant, stated that the Commission might want the applicant to think about whether the accessory apartment can be deeded affordable housing which would also help the Town get closer to their 10% affordable housing in Bethany.  Also, Mr. Peck stated Bethany does not have a regulation that requires this but the applicant can consider.

 

Chair Brinton asked if anyone from the public would like to speak in favor of the application or against the application.  There were no comments.

 

At 7:43 p.m., it was moved by Sullivan and seconded by Calhoun to close the public hearing on the subject application.

Voting for:  Brinton, Sullivan, Calhoun, Goldner, Shea.

NEW BUSINESS

 

1.      Application #2015-013 submitted by Luiza DaSilva for a Zoning Regulation Amendment to Section 1.2 and Section 4.4.E

 

The Commission formally received the application.  No one was present to speak on behalf of this application.

 

The Commission received a letter from Luiza DaSilva, dated July 13, 2015, regarding a request to waiver the fees for this zoning text amendment application.  The Commission briefly discussed this and it was mentioned that Staff has spent hours on the zoning violation at the applicants property and would like to discuss further.  Hiram Peck will put together a breakdown of time spent for the next regular meeting scheduled on September 2, 2015.  It was moved by Sullivan and seconded by Calhoun to table the discussion on fees until the September 2, 2015, Regular Meeting.  Unanimous approval.

 

It was moved by Sullivan and seconded by Shea to schedule a public hearing date of Wednesday, October 7, 2015.  Unanimous approval.

 

 

2.      58 North Humiston Drive, Application #2015-014 submitted by Eric Long for a Home Occupation Permit for property management business office

 

The Commission formally received the application.  No one was present to speak on behalf of this application.

 

Isabel Kearns, ZEO, stated the applicant would like an office in his home for his business.  There will be no deliveries and no outside storage.

 

Commission members discussed and proceeded to deliberate.  It was moved by Sullivan and seconded by Calhoun to approve the following resolution for Application #2015-014:

 

Whereas, Eric Long, applicant, applied to the Planning and Zoning Commission on      August 5, 2015 for a Home Occupation Permit to operate a home office for a property management business located at 58 North Humiston Drive;

 

Whereas, Don Long, owner of 58 North Humiston Drive, authorized his son, Eric Long, to apply for a Home Occupation Permit for a property management business located at 58 North Humiston Drive in an e-mail dated July 28, 2015;

 

Whereas, the Commission, at its regular meeting of August 5, 2015, considered the statement of use, narrative, testimony and other pertinent application information relating to this home occupation application;

 

 

 

 

 

 

Now Therefore, the Commission makes the following findings of fact and decision regarding this application:

1)      Lynne Fox, Quinnipiack Valley Health District Representative, signed off on the back of the application form on July 28, 2015, indicating approval.

2)      Rod White, Fire Marshal, signed off on the back of the application form on July 28, 2015, indicating his approval.

3)      The Commission received an e-mail dated July 30, 2015, from Ron Walters, Representative of South Central Connecticut Regional Water Authority, in which he indicates that this property is not on the Regional Water Authority’s Watershed.

4)      The Commission received an e-mail dated July 30, 2015, from Cindy Gaudino, Representative of the Connecticut Water Company, in which she indicates she has no comments.

 

Now Therefore Be It Resolved, that pursuant to Section 4.3.E.4.b. of the Town of Bethany Zoning Regulations, amended to February 27, 2015, the Bethany Planning and Zoning Commission approves the application of Eric Long for a Home Occupation Permit to operate a home office for a property management business located at 58 North Humiston Drive, as outlined in the Statement of Use dated July 17, 2015.

Vote 5 to 0.

Voting for:  Brinton, Sullivan, Calhoun, Goldner, Shea.

Unanimous approval.

 

 

3.      Preliminary discussion with Tony Falcone regarding possible future ideas for creating a cluster zone concept for saving the golf course at Woodhaven Golf Club, 275 Miller Road, Bethany

 

Present for this discussion were Tony Falcone, Tina Falcone Sierra, Paul Falcone and          Al DaSilva of DSA Corporation.

 

The purpose of this discussion was to receive input from the Commission in regard to keeping the family golf course while developing some of the property for cluster homes. 

 

Hiram Peck, Planning Consultant, suggested owners put preliminary information together and do feasibility study which would benefit them either way.

 

Owners would like Commission members to visit the property.

 

4.      67 Mesa Drive, Application #2015-015 submitted by Connecticut Basement Finishing for a Special Exception Permit for an Accessory Apartment

 

The Commission formally received the application.  No one was present to speak on behalf of this application.

 

Isabel Kearns, ZEO, recommended the Commission schedule a public hearing.  A public hearing was scheduled for the next regular meeting on Wednesday, September 2, 2015, at     7:15 p.m. in the Commission Meeting Room of the Bethany Town Hall.  Tabled.

 

 

 

 

OLD BUSINESS

 

1.      73 Carrington Road, Application #2015-011 submitted by Carol and Darrell Merchant for a Special Exception Permit for an accessory apartment

 

Public hearing was closed.  Commission members discussed and proceeded to deliberate.

It was moved by Sullivan and seconded by Goldner to approve the following resolution for Application #2015-011:

 

Whereas, Carol and Darrell Merchant, owners of 73 Carrington Road, applied to the Planning and Zoning Commission on July 1, 2015, for a Special Exception Permit for a   592.1 square foot accessory apartment to be located within a newly proposed 24-foot by    24-foot addition to the existing home at property known as 73 Carrington Road;

 

Whereas, the Planning and Zoning Commission opened a public hearing on Application    #2015-011 for a Special Exception Permit for an accessory apartment located at                   73 Carrington Road on August 5, 2015.  Said public hearing was closed at the conclusion of testimony that same evening;

 

Now Therefore, the Planning and Zoning Commission makes the following findings of fact and decisions regarding the application:

  1. Quinnipiack Valley Health District approved Permit #1654 for an attached accessory apartment at 73 Carrington Road on July 10, 2015.
  2. Roderick White, Fire Marshal, signed off on the back of the application form and stated that he has no jurisdiction over single family/in-law occupancy.
  3. The application and Statement of Use dated June 29, 2015, demonstrates that the proposed accessory apartment would contain only 592.1 square feet of living space, and the Town of Bethany Zoning Regulations allows a maximum of 700 square feet of living space.
  4. The Commission received a letter dated July 30, 2015 from Ronald Walters of the South Central Connecticut Regional Water Authority in which he states that he has no comment.

 

Now Therefore Be It Resolved, that pursuant to Section 4.4.J. of the Bethany Zoning Regulations, amended to February 27, 2015, the Bethany Planning and Zoning Commission approves the application of Carol and Darrell Merchant for a Special Exception Permit for a 592.1 square foot accessory apartment (#2015-011) as shown on the following submitted plans:

1.      “Property Map”, dated July 15, 2015, with no revisions, prepared John Paul Garcia & Associates, Bethany, Connecticut.

2.      “Plans & Elevation”, dated July 30, 2015, with no revisions, prepared DonMar, North Haven, Connecticut.

and as per the Statement of Use dated June 29, 2015.          

 

 

 

 

 

 

 

And with the following conditions:

1)                 The owner of the property shall provide to the Commission an annual affidavit, due prior to occupancy of the apartment and during the month of January each year, to the effect that the accessory apartment continues to be in full compliance with Section 4.4.J. of the Bethany Zoning Regulations.

2)                 A building permit for the accessory apartment must be submitted and approved by the building official prior to any construction.

Vote 5 to 0.

Voting for:  Brinton, Sullivan, Calhoun, Goldner, Shea.

Unanimous approval.

 

 

2.      Discuss future Land Use Plan (possible insertion in Town Plan of Conservation & Development) 

 

Hiram Peck, Planning Consultant, stated he spoke with Mr. Hind of the Center for Land Use Research regarding a study where they would review our zoning regulations which would help save funds and benefit us.    Hiram will email.  Tabled.

 

3.      Discussion regarding types of signsTabled.

 

4.      Discussion regarding the rewriting of the current Zoning Regulations

 

Isabel Kearns, ZEO, stated that an ad for Request for Proposal was published in New Haven Register for the rewriting of the regulations and the deadline is August 31, 2015 at 4:00 p.m.

5.      50 Hunters Trail (Sun Gold Stables), Discussion regarding second equine business operating from the property – Remove from agenda. 

 

 

OTHER BUSINESS

 

Executive Session with First Selectwoman Derry Gorski regarding Personnel and Contracts

 

At 8:35 p.m., it was moved by Sullivan and seconded by Calhoun for the Commission to enter into an executive session.  Derry Gorski, First Selectwoman and Hiram Peck, Planning Consultant, were invited into the executive session.  Unanimous approval.

 

At 8:54 p.m., it was moved by Sullivan and seconded by Shea for the Commission to exit out of executive session.

Unanimous approval.

 

For the record, no votes were taken in the course of the executive session.

There being no further business to come before the Commission, it was moved by Sullivan and seconded by Shea to adjourn the regular meeting at 8:55 p.m.

MINUTES OF THE BETHANY INLAND WETLANDS COMMISSION REGULAR MEETING OF MONDAY, JULY 27, 2015                                                         Page 1 of 6

The regular meeting of the Inland Wetlands Commission was called to order at 7:35 p.m. in the Commission Meeting Room in the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following members of the Commission were present:

         Alexandra Breslin, Chair

         Kristine Sullivan, Vice-Chair

         Brian Smith, Member

         Roger Hathaway, Member

         Lisa Gaw, Member

         Nancy Scanlon, Alternate Member

 

Also present was:

         Isabel Kearns, Inland Wetlands Enforcement Officer

 

NEW BUSINESS

 

1)      10 Northrop Road, Application #1245 submitted by Douglas Kycia, Landscape Architect for an Inland Wetlands Permit for Upland Area Mitigation Plan

 

The Commission formally received the application.  Present for this discussion was             Mr. Doug Kycia, Landscape Architect, applicant representing the owner of record, Situ Patel.

 

Mr. Kycia briefly reviewed the proposed project and noted in discussion:

·         Submitted eight sheets of photographs of the subject property.

·         Responding to the Biological Assessment Report by Evans Associates dated May 19, 2015.

·         Reviewed addendum to application he submitted on July 17, 2015.

·         Artificial watercourse, which is not used all the time, circulates water through watercourse and back into pond.

·         Upland area that was cleared.  What started the clearing were the ash trees that died.  Proposing new planting of trees.

·         Water’s edge has grown back. 

·         Existing line of hay bales deteriorating and will be replaced.

·         Would like to get invasive plants under control by removing and then when return spray with herbicide.

·         Asking that a good part of the lawn remain so that owner can get down to water.

 

In discussion, Commission members noted:

·         No permit for the creation of the watercourse (artificial stream).

·         Create a deeper buffer than what is being shown.

·         Recommend the Commission engage a professional to review and comment on the plan.

 

 

 

 

 

 

 

Isabel Kearns, IWEO, stated she visited the site when owner removed trash and monitored the site.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, August 24, 2015.  Tabled.

 

 

2)       96 Woodcutters Drive, Application #1246 submitted by Gary Leydon for an Inland Wetlands Permit to replace and extend existing deck

 

The Commission formally received the application.  Present for this discussion was

Gary Leydon, applicant and owner of record.

 

Mr. Leydon briefly reviewed the proposed project and noted in discussion:

·         Pond basically fills up with rain water.

·         Clay underneath so water does not drain and has located rocks around perimeter.

·         Pond was area that was wet, huge water flow and dug some of the depressed area.

 

In discussion, Commission members noted:

·         Would like to visit site to check out pond.

·         Not aware of any water body in that location   .

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, August 24, 2015.  Tabled.

 

 

OLD BUSINESS

 

1.      33 Old Amity Road and 9 Russell Road, Application #1241 submitted by Manuel Preta for an Inland Wetlands Permit to construct a building for masonry supply and a storage yard

 

Present to speak on behalf of the application was Wayne Zirolli, P.E./L.S. representing the applicant, Manuel Preta, who was also present.

 

Some Commission members visited the site on July 11, 2015.

 

Mr. Zirolli briefly reviewed the proposed project and noted in discussion:

·         Proposing a 120 foot by 120 foot building.

·         Moved building back another 10 feet as requested.

·         Adjoiner concerned about access around building and therefore, depicted stone base around building to access.

·         Paving at entrance only.

·         Will install a low stone berm around the active area of the property.

·         No catch basins proposed at this time.

·         Installing drainage would concentrate flows as it dissipates off property naturally.

·         Intermittent watercourse flows east to west on property.

 

 

·         Added anti-tracking pad and filter fabric fence to plan.

·         On deed no current restrictions but note for Lot 2 stated property may be used only for recreation purposes any changes of use to Lot 2 must be approved by Planning and Zoning Commission, which this proposed project will be submitted to Planning and Zoning.

 

In discussion, Commission members noted:

·         Septic is pump system.  Received Quinnipiack Valley Health District approval for septic system in letter dated June 2, 2015.

·         No drainage calculations.  Engineer can provide calculations for roof area.

·         Area where proposed building to be located is a little less than half of existing pavement.

·         Existing office trailer will be removed and debris will be removed.

·         Stone check dam/berm – would like sketch with details.

·         Catch basin at Old Amity Road needs to be cleaned.

·         Culvert the runs under Route 63 and detention area has a lot of road sand.

·         Would like details on anti-tracking pad and roof drains.

·         Additional construction details need to be shown on plan.

·         Would like details on pipe for septic crossing.

·         Plans need to reflect construction process for a contractor and IWEO to view when out in field.

·         Need equipment maintenance narrative.

·         Engineer will revise plans.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, August 24, 2015.  Tabled.

 

2.      153 Amity Road, Application #1243 submitted by Mark Sette for an Inland Wetlands Permit to clear cut around the wetlands

 

No one was present to speak on behalf of the application.

 

The Commission received a letter from Mr. Sette, dated June 26, 2015, requesting a waiver of a portion of the fees.  Also, the Commission received a copy of an On-Site Soil Investigation Report, dated May 30, 2015.

 

Some Commission members visited the site on July 11, 2015.

 

In discussion, Commission members noted:

·         Applicant’s future proposal is to put storage building with a possible living area above building.   This application is for just clear cutting. 

·         Applicant wants to clear cut to access property and remove debris on property.

·         Can’t just clear cut property; needs to decide what intentions are for property; not as-of right.

·         Not clear what applicant is proposing.

 

 

 

 

·         Applicant needs to come in and explain exactly what his plans are for better understanding by the Commission.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, August 24, 2015.  Tabled.

 

 

3.      Raccio Road, Application #1234, submitted by the Town of Bethany for an Inland Wetlands Permit to remove and replace drainage system including catch basin’s and outfalls and reclaim road

 

No one was present to speak on behalf of this application.

 

It was moved by Sullivan and seconded by Smith to deny, without prejudice, Application #1234 submitted by the Town of Bethany for an Inland Wetlands Permit to remove and replace drainage system including catch basin’s and outfalls and reclaim road and when input received from consulting engineer, applicant needs to resubmit. 

Voting were:  Breslin, Sullivan, Smith, Gaw, Hathaway.

Unanimous approval.

 

4.      Show Cause Hearing regarding Cease and Desist Order, dated October 21, 2014, to Mrs. Bitina Patel of 10 Northrop Road, extension of patio, stonewall along the pond, waterfall and clear cutting of trees within the 150-foot upland review area without permitTabled.

2.      It was moved by Gaw and seconded by Scanlon to approve, as submitted, the minutes of the Saturday, July 11, 2015, Special Meeting/Site Visit.
