First Selectwoman Gorski called the meeting of the Board of Selectmen to order at 7:30 p.m.  The meeting was held in the Selectmen’s Conference Room of the Bethany Town Hall.   
APPROVAL OF MINUTES
First Selectwoman Gorski called for a motion of approval for the minutes of the meeting of March 28, 2016.  The motion of approval was moved by Selectman Hurlburt and seconded by Selectman Shea.  The minutes were amended by correcting the spelling of Catherine Weiss’s name.  They were then approved on a unanimous vote. 
USE OF TOWN HALL AND LAKEVIEW LODGE KITCHEN
Rosco’s Traveling Smoke House, a locally owned business has requested use of the Lakeview Lodge or Town Hall kitchens to cook for large parties.  Following discussion for use, and fees to be charged, it was determined that the fee charged would be the same as renting the school kitchen.   Their fee is $50 for the first hour and $15 per hour for each additional hour used.  Selectman Hurlburt questioned whether this would open the door for other similar requests.   The Selectmen discussed notification for use.  It was determined that there would need to be at least a two week window of use so that it would not affect rentals and use by civic organizations. 
HOUSATONIC MODEL SAILING BOAT CLUB
Don Ouimette, member of the Housatonic Model Sailing Boat Club gave a presentation to the Selectmen regarding how the radio controlled sail boats operate with regard to racing.  The club uses Hop Brook for the season from Memorial Day to Labor Day for their races.   They are asking if the club could use the lake at Veterans Memorial Park from early April to Memorial Day and after Labor Day to hold their events since Hop Brook is closed during this time.  First Selectwoman Gorski will discuss libality with the insurance company and the Town Attorney on this use before a final decision is made. 
OTHER MATTERS PROPER TO COME BEFORE THE MEETING
First Selectwoman Gorski reported that the Annual Budget Hearing has been set for April 27, 2016 at 7:00 p.m.
First Selectwoman Gorski has notified all civic organizations and political committees not to drive on the grass near the Town Hall kitchen. 
ADJOURNMENT
Adjournment was called at 8:05 p.m. after a motion was moved by Selectman Shea and seconded by Selectman Hurlburt.  The vote taken was unanimous.

MINUTES OF THE BETHANY PLANNING AND ZONING COMMISSION SPECIAL MEETING OF WEDNESDAY
The Special Meeting of the Planning and Zoning Commission was called to order at 7:03 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.
 
The following Commission Members were present:
            Kimberly McClure Brinton, Chair
            Michael Calhoun, Member
            Donna Shea, Member
            Bradford Buchta, Alternate Member
            Carol Lambiase, Alternate Member, seated as a voting member
            Eric McDonald, Alternate Member, seated as a voting member
 
The following Commission Members were absent:
            Douglas Goldner, Member
            Michael Sullivan, Vice-Chairman
 
Also present were:

  • Public Hearing and possible action on Application #2016-004 submitted by Akbar Dar for property located at 23 Tollgate Road for a Special Exception Permit for an Accessory Apartment
 
At 7:04 p.m., Chair Brinton called the public hearing to order.   Roll call was taken.  Chair Brinton read the legal notice for the public hearing.  Chair Brinton reviewed the complete application file.
 
Isabel Kearns, ZEO, spoke on behalf of the applicant who was not present.  Ms. Kearns stated that the application meets all the criteria and the applicant has received the necessary approvals.
 
Chair Brinton asked if anyone from the public would like to speak in favor of the application or against the application.    There were no comments.
 
At 7:09 p.m., it was moved by Calhoun and seconded by Shea to close the public hearing on the subject application.
Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.

Commission members proceeded to deliberate.  It was moved by Calhoun and seconded by Lambiase to approve the following resolution for Application #2016-004:
 
Whereas, Akbar Dar, owner of 23 Tollgate Road, applied to the Planning and Zoning Commission on April 6, 2016, for a Special Exception Permit for a 197 square foot accessory apartment (including bath, bedroom and small kitchen)  to be located within a portion of the first floor of the existing home located at property known as 23 Tollgate Road;
 
Whereas, the Planning and Zoning Commission opened a public hearing on Application #2016-004 for a Special Exception Permit for an accessory apartment located at 23 Tollgate Road at their Special Meeting of May 11, 2016.  Said hearing was closed at the conclusion of testimony that same evening;
 
Now therefore, the Planning and Zoning Commission makes the following findings of fact and decisions regarding the application:
  1. Lynn Fox, Quinnipiack Valley Health District Representative, signed off on the back of the application form on April 15, 2016, indicating her approval.
  2. The Commission received an e-mail dated April 13, 2016, from Cindy Gaudino of the Connecticut Water Company stating that she has no comment.
  3. Roderick White, Fire Marshal, signed off on the back of the application form on May 6, 2016, indicating his approval.
  4. The application and Statement of Use dated March 30, 2016, demonstrates that the proposed accessory apartment would contain only 197 square feet of living space, and the Town of Bethany Zoning Regulations allows a maximum of 700 square feet of living space.
 
Now Therefore Be It Resolved, that pursuant to Section 4.4.J. of the Bethany Zoning Regulations, amended to October 30, 2015, the Bethany Planning and Zoning Commission approves the application of Akbar Dar for a Special Exception for a 197 square foot accessory apartment (#2016-004) (including bath, bedroom, and small kitchen) as shown on the submitted floor plan dated April, 2016 and as per the Statement of Use dated March 30, 2016.          
 
And with the following conditions:
  1. The owner of the property shall provide to the Commission an annual affidavit, due prior to occupancy of the apartment and during the month of January each year, to the effect that the accessory apartment continues to be in full compliance with Section 4.4.J. of the Bethany Zoning Regulations.
  2. A building permit for the accessory apartment must be submitted and approved by the building official prior to any construction.
    Vote 5 to 0.
    Voting for:  Brinton, Calhoun, Shea, Lambiase, McDonald.

  • Public Hearing and possible action on the following Applications submitted by 667 Amity Road LLC/Matt Micros for property located at 667, 679, 681, 687 Amity Road (to be heard together):
  1. Application #2016-003 for a Site Plan Approval to construct 2 outdoor soccer fields and a new building.
  2. Application #2016-006 for a New Use Permit to operate an office for soccer fields/sports use.
  3. Application #2016-007 for a Special Exception Earth Removal, Excavation, Stockpiling, Filling and Grading Permit.
 
At 7:10 p.m., Chair Brinton called the public hearing to order.   Roll call was taken.   Chair Brinton read the legal notice for the public hearing.  Chair Brinton reviewed the complete application files.
 
During the course of the public hearing, Chair Brinton noted that the Commission has received the following item relative to the subject application.  Exhibit identification was assigned as noted:
  1. Exhibit 1A – Outline of the Connecticut Football Club, submitted April 14, 2016.

Present to speak on behalf of these applications were the following:
  • John Paul Garcia, P.E., representing the applicant, Matt Micros.

Mr. Garcia presented an overview of the proposed project and noted some of the following from the plans:
  • The parking in front will be paved for 35 cars.
  • Back parking will be gravel, changing plans to 84 parking spaces.
  • Whatever material leftover we will use for stormwater management systems and around the building.
  • Soccer fields not impervious, turf field.
     
 
  • Department of Transportation has no issues.  Not a high volume operation; still using existing curb cuts.
  • Full cutoff lights on back and side of building for parking.  No lights on fields.
  • As part of the record, the Commission received a report from the Department of Public Health and the Regional Water Authority which have no issues.
  • Also received septic approval from Quinnipiack Valley Health District.
 
Matt Micros the applicant, discussed hours of operation and that he is also a soccer coach and would like to let schools use indoor and outdoor fields at times.
 
Hiram Peck, Planning Consultant, asked Mr. Garcia if Town Engineer Dave Nafis reviewed the map with the 84 parking spaces in back.  Mr. Garcia stated he will review with Mr. Nafis and wait for comments.  Also, Mr. Peck asked for architectural plans.  Mr. Micros submitted Exhibit 8A.
   
Chair Brinton mentioned the neighbors were not noticed so the Commission will continue the public hearing and that the neighbors can listen to recording.
 
Chair Brinton asked if anyone from the public would like to speak in favor of the application or against the application.

The Commission scheduled a Special Meeting/Site Visit/Hearing Continuation for Wednesday, June 1, 2016, at 6:00 p.m.   Commission members to meet at the site.
 
At 8:17 p.m., it was moved by Calhoun and seconded by Shea to recess the public hearing and continue the public hearing to the next regular meeting scheduled for Wednesday, June 1, 2016, in the Commission Meeting Room of the Bethany Town Hall.  Public hearings will start at 7:15 p.m.

Bethany Conservation Commission Meeting Minutes (Approved)
April 14, 2016
Bruce Loomis called the meeting to order at 8:05.  Also in attendance were Brian Eitzer, Matthew Popp and Cathy Rives.  Absent were Shaukat Khan and Patsy Winer.  Bruce appointed Matthew to vote in place of Shaukat.
The March meeting minutes were reviewed.  Brian moved to accept once the date had been corrected.  Bruce seconded and the minutes were passed as corrected.
There were no new bills.  There was correspondence from the Aquarion Water company soliciting businesses to nominate for the Environmental Champion Award.  Patsy Winer has submitted a nomination
The Commission discussed the Conservationist Award given to two BCS students.  The award has traditionally been $60 for two award winners.  After discussion, Bruce moved to pre-approve the awards up to $100.  Brian seconded, all were in favor and the motion passed.
There will be a hearing about the Peck Road affordable housing application on May 4th at 7pm.  This commission has concerns about fire safety.
A new application has been received for soccer fields to be created at 667-681 Amity Road (where the driving range now stands).  The proposal is for the creation of two outdoor fields and construction of a building with two indoor fields.  The hearing will be in May.  The commission discussed concerns about the texture and color of the building (that will be evident from Amity Road) and any screening between the proposed parking lot and Amity Road
Discussion about zoning regulations was tabled.
The Commission entered  executive session at 8:36 to discuss Conservationist of the Year.  A vote was taken and decision made.  Executive session was ended at 8:47.
Bruce reminded everyone about the CACIWC conference which is scheduled to be held on November 12, 2016.  All are encouraged to attend.
As there was no other business, Matthew moved to adjourn at 8:55.  Brian seconded and the meeting was adjourned

The Commission formally received the application.   Present to speak on behalf of this application was Isabel Kearns, Zoning Enforcement Officer.
 
Commission members discussed and proceeded to deliberate.  It was moved by Calhoun and seconded by Lambiase to approve the following resolution for Application #2016-009 for a CGS Section 8-24 Review:
 
Whereas, Section 8-24 of the Connecticut General Statutes requires that a municipality refer proposals that will expend Town money to the Planning and Zoning Commission for a report; and
 
Whereas, First Selectmen Derrylyn Gorski, has requested such a report in a letter dated April 29, 2016, relative to the location of a proposed bulk storage dome approximately 100 feet in diameter to be located at 755 Amity Road (airport property); and
 
 
 
 
 
 
 
Now Therefore Be It Resolved, that the Bethany Planning and Zoning Commission hereby finds that the 100-foot diameter bulk storage dome to be located at 755 Amity Road (to the north of the existing Town Garage) is not in conflict with the Town Plan of Conservation and Development adopted November 18, 1998 and last revised August 31, 2010.
Voting for:  Brinton, Calhoun, Shea, Buchta, Lambiase.

Approximately, 17 individuals were in attendance for the public hearing for Application #2016-002 submitted by James Sakonchick for the property located at 4 Peck Road.
 
At 7:18 p.m., Chair Brinton called the public hearing to order.   Roll call was taken.              Chair Brinton read the legal notice for the public hearing.  Chair Brinton reviewed the contents of the application file.
 
During the course of the public hearing, Chair Brinton noted that the Commission has received the following items relative to the subject application.  Exhibit identification was assigned as noted:
  1. Exhibit 1A – – Letter from Ronald Walters, Regional Water Authority, dated      April 15, 2016, Re:  Comments on review of application for 4 Peck Road – four unit multi-family residence.

  3. Exhibit 1E – Memo from Hiram Peck, Planning Consultant, dated April 30, 2016, Re:  Review comments on application for Affordable Housing Development at 4 Peck Road.
 
James Sakonchick, owner and applicant for 4 Peck Road, introduced himself and began his presentation.
 
Some of the areas Mr. Sakonchick reviewed are as follows:
    • The Commission approved the application to build a mansion previously on this property and this proposal is smaller.
    • These are single family homes; four separate structures.
    • There are firewalls separating the units.
    • Maximum height of structure is 34 feet.
    • Developing some housing which is more affordable.
    • Judge demanded this case back to Planning and Zoning Commission.
    • This Commission needs to make a decision within 60 days of the Judge’s order.
    • Discussed memorandum of decision dated December 2, 2015.
    • Reviewed affordability plan.
    • Discussed Administrator for property.
 
Next, Mr. Sakonchick introduced Mr. Scott Hesketh of F.A. Hesketh & Associates, Inc., East Granby, Connecticut, who reviewed his Traffic Report dated February 12, 2016, contained in the application packet received March 2, 2016.
 
Mr. Sakonchick then submitted General Safety Standards (Exhibit 1D) as a supplemental to Mr. Hesketh’s report.
 
Mr. Sakonchick addressed the letter from Mr. Rod White, Fire Marshal, dated May 3, 2016.  Mr. Sakonchick feels the standard for fire protection Mr. White is asking for is above the minimum requirement of the State of Connecticut.
 
Mr. White, Fire Marshal, responded that a 30,000 gallon water tank is in the requirements and he considers this proposal as five individual houses.
 
Chair Brinton then read in order the names on the sign-up sheets so that the public can comment.  The following public individuals spoke:
  • Bruce Loomis of Sabrina Drive and Chairman of the Conservation Commission.
  • Jason MacNevon of 15 Peck Road.
  • John Paul Garcia of 190 Fairwood Road.
  • Sharon Huxley of 340 Old Mill Road

Mr. Sakonchick then responded to the public comments on the traffic and parking.
 
Chair Brinton recessed the public hearing at 9 p.m. for a brief break.  The hearing commenced at 9:15 p.m.
 
Commission members addressed the applicant with questions relating to some of the following area:
  • Elevations of structure need to be confirmed.
  • Driveway.
  • Need full traffic study.
  • Parking.
 
Peter Olson, Special Counsel, addressed Mr. Scott Hesketh of F.A. Hesketh & Associates, Inc. concerning the following:
  • Traffic Report in packet dated February 12, 2016, Re:  Available Sight Distance, Hotchkiss Set-Aside Development, 4 Peck Road.
  • Did you review the Town of Bethany Road Ordinance?
  • Did you review the accident history of the section of road near 4 Peck Road?
 
Hiram Peck, Planning Consultant, commented on:
  • Proposed elevations of new multifamily dwelling needs clarification.
  • Quinnipiack Valley Health Department needs to answer questions on the septic system.
  • Discrepancies on site plan.
  • Traffic issues.
 
Peter Olson, Special Counsel, addressed Mr. James Sakonchick concerning the following:
  • Standard Site Distance.
  • Did you review the Town of Bethany Road Ordinance?
  • With the initial application, did you file Drainage Report with drainage calculations?  (Applicant stated yes.)
  • Mandatory to provide a well screening report to the Department of Public Health.  Need to provide this before next public hearing.
  • Discussed the Administrator; need to hire someone from the outside.
  • Show parking spaces on site plan.
  • Commission needs to see survey showing where all common elements will be and needs to see Condo Association Declaration and Rules and Regulations.  Need these documents prepared and submitted for review.

It was moved by Calhoun and seconded by Shea to schedule a Special Meeting/Site Walk/Hearing Continuation date of May 11, 2016, at 6:00 p.m. at the property located at       4 Peck Road pertaining to Application #2016-002 submitted by James Sakonchick to obtain site plan approval of “Set-Aside Development” for new construction of a 4-Unit Multi-Family Dwelling in accordance with CGS 8-30g.
Voting for:  Brinton, Calhoun, Shea, Buchta, Lambiase.
Unanimous approval.
