MINUTES OF THE BETHANY INLAND WETLANDS COMMISSION REGULAR MEETING OF MONDAY, MARCH 24,  2014                                            Page 1 of 10


The regular meeting of the Inland Wetlands Commission was called to order at  7:35       p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following members of the Commission were present:

         Alexandra Breslin, Chair

         Kristine Sullivan, Vice-Chair

         Brian Smith, Member

 

The following member of the Commission was absent:

         Roger Hathaway, Member

         Lisa Gaw, Member

 

 

 

Also present were:

         Isabel Kearns, Inland Wetlands Enforcement Officer

         Karen Hubbell, Assistant Inland Wetlands Enforcement Officer

         Kevin McSherry Town Attorney

 

 

NEW BUSINESS

 

No new business.

 

 

OLD BUSINESS

 

1.      Schaffer Road (east to west portion), Application #1214 submitted by the Town of Bethany for an Inland Wetlands Permit to widen and reclaim road and replace or repair existing drainage – No one was present to speak on behalf of this application.

 

Reviewed new plan that was submitted by paul.  Representing mr. green. 

Not sanIndex 6 not sanding the road as much.

Accept and approve that as shown on the plan that the improvements to the outlet should decrease the debris 

The Commission visited the site on February 2, 2014.

 

The Commission noted the following:

·         Heavy water flow on the north side of Schaffer Road.

·         Would like the applicant to furnish additional details on proposed riprap.

·         On the north side of Schaffer Road, the catch basins exit into a swale and there is a lot of scouring.  Need more intense area of control of the water to keep it from scouring. 

·         Applicant is showing a riprap plunge pool on plan; will that be sufficient.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting on Monday, March 24, 2014.  Tabled.

 

2.      Lebanon Road (between 8 and 22 Lebanon Road), Application #1215 submitted by the Town of Bethany for an Inland Wetlands Permit to extend shoulders on road and filling of side slopes with bank-run gravel then cover with 12” and 18” of wood chips for erosion controls and to allow natural vegetation to regrow

The Commission visited the site on February 2, 2014.

 

The Commission noted the following:

  • The road was created prior to wetlands and therefore, crosses a wetland.
  • Very steep slope and concerned that the proposed filling is not going to solve the problem of erosion.
  • Asked Diversified Technology Consultants to review.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting on Monday, March 24, 2014.  Tabled.

 

 

 

 

 

 

6.      24 Dayton Road, Application #1216 submitted by Scott Farquharson for an IW Permit to construct a 24-foot by 29-foot and 5-inches garage and addition above –

 

The Commission formally received the application.  Present to speak on behalf of this application was Scott Farquharson, representing the owners.

 

We did go out to Dayton road.

Mr. Farquharson noted the following:

  • He will be constructing a garage addition with a second floor above which will be attached to the existing home.
  • Will be installing silt fencing during construction so there will be no impact to the wetlands.
  • This project is not encroaching the wetlands.

 

In discussion, Commission members noted:

  • Would like to visit the site.
  • Asked the builder to place stakes where end of addition would be located.

1.      19 Deerfield Lane, Application #1217 submitted by Vincent Franco for an Inland Wetlands Permit to locate and attached garage with furnace and room above garage

 

One big boulder that they should push back.

Isable important that you field check this before and during construction.

2.      755 Amity Road – Discussion on Community Garden – No one was present for this discussion.  Tabled.

3.      4 and 21 Meyers Road, Application #1209 submitted by Green Haven Inc. for a Site Plan and Stormwater Management Plan Review for multi-unit residential community and farm – Public hearing continued to March 24, 2014.

 

4.      Old Mill Road – Drainage and erosion issues – Spoke to ron walters and ball in his court.he is going to take action.  Tabled.

 

5.      Discussion regarding Bethany West clearing.  (Letter from Roman Mrozinski of the Southwest Conservation District) – Tabled. Sandy and Kris meet with cons comm..

8.   185 Beacon Road, Discussion with Daniel Cusano regarding non-permitted barn  will send copy of pics and say we noticed you doing more work.  letterThe Commission visited the site on February 2, 2014, and took pictures.  The Commission noted that they did not see any new disturbance at rear lot (187 Beacon Road – Gaetano is all site) just old silt fence but did notice that at 185 Beacon Road (Cusano) there was a payloader and debris was being pushed  into the wetlands.  Tabled. 

 

9.   Continuation of Show Cause Hearing regarding Town of Bethany drainage repairs

      conducted in a regulated area without an Inland Wetlands PermitTabled.

 

10. Update on appeal submitted by James Woodward for 46 Mesa DriveTabled.

 

11. Discussion in regard to amendments to the Inland Wetlands Regulations per State

      of CT  Tabled.

 

 

APPROVAL OF MINUTES

 

1.      It was moved by                and seconded by                  to approve, as amended, the minutes of the February 24, 2014, Regular Meeting.

      Voting were:  Breslin, Sullivan, Hathaway, Smith.

      Unanimous approval.

 

 

 

BILLS

 

1.   It was moved by Sullivan and seconded by Smith to approve the payment of $105.00 for

      recording services rendered at the public hearing held on January 27, 2014, (4 and 21 Meyers

      Road) by Anne Sohon.

      Voting were:  Breslin, Sullivan, Hathaway, Smith.

      Unanimous approval.

The Commission scheduled a site visit for Sunday, March 16, 2014, at 9:00 a.m.  Commission members to meet at the Town Hall and proceed to the following properties:

  • 24 Dayton Road
  • 19 Deerfield Lane

 

 

 

 

 

 

PUBLIC HEARING

·         4 and 21 Meyers Road, Application #1209 submitted by Green Haven Inc. for a Site Plan and Stormwater Management Plan Review for multi-unit residential community and farm -

 

At  8:03 p.m., Chair Breslin called to order the public hearing continuation on the subject application.  Chair Breslin read the notice prepared for the public hearing.   Chair Breslin briefly reviewed the process of the public hearing and introduced the Commission members and staff.

 

Christopher Smith, Land Use Attorney, and Partner of Law Firm, Shipman and Goodwin, representing Green Haven Inc. introduced himself.

Continuation third night continue with dialogue from fire marshal office driveway and underground tanks.  Mr. white attended public hearing last week.

Submitted revised set of plans.

Have not had a final

Asking to continue the public hearing.

 

Mr. daly did provide a set to andy to look at.   Minor revisions.  Don’t involve any regulated activities.

Tom daly what we r talking about is one or two tanks.  With of central road 1Index 2.  there is opportunity to do residential sprinklers.  Driveway width.  Continue to run numbers and don’t make any changes.

Ponds in same locations. 

Really about reworkings of the core not the perimeter.

Andy just noticed a few changes on the plans.  No major issues and will have conversation with mr. daly.

Attorney Smith stated that the plans will be revised due to comments from the Fire Marshal, Bethany Volunteer Fire Department, Nafis & Young and Regional Water Authority and he suggested continuing the public hearing. 

 

Attorney Smith then turned the presentation over to Thomas Daly, P.E. and Principal of Milone & MacBroom, who reviewed the revisions to the plans.  Some areas Mr. Daly touched on are as follows:

·         Wells are being moved to a different location from working with the Regional Water Authority.

·         Working with the Fire Marshal and Bethany Volunteer Fire Department and will provide a secondary accessway from Meyers Road.

·         Reducing main driveway down to 22 feet in width.

·         Rear driveway adding little bump outs to parking area.

·         Septic system being moved due to well relocation and will have to resubmit to Quinnipiack Valley Health District for approval.

·         Relocating water tank.

·         Addressed issue with ponds and mosquitoes.

 

Andy Bevilacqua of Diversified Technology Consultants was present.  Mr. Bevilacqua reviewed his letter dated January 2, 2014, in response to his review of the plans and report provided by the Developer’s Engineer.   Mr. Bevilacqua stated all his major concerns on the project have been addressed but he will have to review the revised plans when available.

 

Some items mentioned from the Commission members were:

·         Maintenance schedule for the detention basins.

·         Propose a bond and itemize what the bond will cover so that DTC can review.

 

Mr. Bevilacqua mentioned that if the developer half way through construction walks away, the Town needs money to restore the site.

 

 

 

 

Attorney Smith mentioned that at the last public hearing the Inland Wetlands Commission wanted the record of the Halter Estates Wetlands application incorporated into this hearing record.  Attorney Smith stated that this application stands on its own.  If there is anything in that particular record that you would like to have addressed, please let us know so that we can address.

 

Chair Breslin asked if there was anyone from the audience that would like to comment.  No one commented.

 

Attorney McSherry mentioned in regard to the yearly maintenance the applicant may consider putting this in the bylaws of the Association and require them to have a capitol account.

 

Chair Breslin made a disclosure on the hearing record again that she serves the Town as a member of the South Central Connecticut Regional Water Authority Policy Board.

 

Chair Breslin stated that she has asked the Inland Wetlands Commission Members to submit a paragraph or resume stating their qualifications.  Brian Smith submitted a sheet with his experience information.

 

Member Sullivan mentioned she received a call from Tom Cavaliere (the seller’s attorney) this afternoon regarding the application and she did not speak to him.

 

Attorney Smith submitted consent to extension of time to continue the public hearing to       March 26, 2014.

 

At 8:40 p.m., Chair Breslin recessed the public hearing and continued the public hearing to the next regular meeting date of Monday, March 24, 2014, at 8:00 p.m. in the Commission Meeting Room of the Bethany Town Hall. 

 

 

ADJOURNMENT

 

There being no further business to come before the Commission, it was moved by Smith

and seconded by Sullivan to adjourn the regular meeting at 8:50.  Unanimous approval.
