MINUTES OF THE BETHANY INLAND WETLANDS COMMISSION REGULAR MEETING OF MONDAY, JUNE 22, 2015                                                        Page 1 of 5

 

The regular meeting of the Inland Wetlands Commission was called to order at 7:35 p.m. in the Commission Meeting Room at the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following members of the Commission were present:

         Alexandra Breslin, Chair

         Brian Smith, Member     

         Roger Hathaway, Member

         Nancy Scanlon, Alternate Member, seated as a voting member

 

The following members of the Commission were absent:

         Kristine Sullivan, Vice-Chair

         Lisa Gaw, Member

 

Also present was:

         Isabel Kearns, Inland Wetlands Enforcement Officer

 

 

NEW BUSINESS

 

1)      33 Old Amity Road and 9 Russell Road, Application #1241 submitted by Manuel Preta for an Inland Wetlands Permit to construct a building for masonry supply and a storage yard

 

The Commission formally received the application.  Present for this discussion was Wayne Zirolli, P.E./L.S. representing the applicant, Manuel Preta, who was also present.

 

Mr. Zirolli briefly reviewed the proposed project and noted in discussion:

·         Received Quinnipiack Valley Health District approval for septic system in letter dated June 2, 2015.

·         No floor drains proposed in building.

·         Building will be on slab.

·         Will be submitting a lot line revision plan due to septic being located on other lot (9 Russell Road).

 

In discussion, Commission members noted:

·         Building will be for storage of construction materials and some equipment.

·         Commission would like to conduct site visit.

·         Mr. Zirolli will review letter from IWEO dated June 22, 2015, and revise plans as necessary for next regular meeting, July 27, 2015.

 

 

 

 

 

 

Also, Mr. Stuart Paley of 36 Old Amity Road submitted a letter dated June 16, 2015.  Mr. Paley expressed his concerns regarding the proposed development and the contamination to the wetlands.  Also, Mr. Paley stated he believed there was a deed restriction on this property as a recreational facility.  The IWEO will research the Land Records and follow up at the next regular meeting.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, July 27, 2015.  Tabled.

 

2)      27 Pine Brook Crossing, Application #1242 submitted by British Botanicals for an Inland Wetlands Permit for landscaping

 

The Commission formally received the application.  Present for this discussion was John Kirkham of British Botanicals representing the property owners, Chuck and Wendy Gamsu.

 

Mr. Kirkman reviewed the proposal he submitted dated May 8, 2015, which included fence line screening, rear lawn area adjacent to house, front entrance to home, lawn and plant areas adjacent to driveway (left side) and island in center of driveway.

 

In discussion, Commission members noted:

·         Basic idea is not to disturb wetlands and to not cause erosion on the property.

·         Reviewed proposal as to what would fall under permit and what is allowed to do now.

·         Make sure use silt fence for sedimentation and erosion control.

 

In discussion, it was the consensus of the Inland Wetlands Commission that the planting plan, dated May 8, 2015, submitted by Mr. Kirkham, as presented, does not require an Inland Wetlands Application.

 

 

3)      153 Amity Road, Application #1243 submitted by Mark Sette for an Inland Wetlands Permit to clear cut around the wetlands -

 

The Commission formally received the application.  Present for this discussion was Mark Sette, applicant and owner of record.

 

Mr. Sette briefly reviewed the proposed site development and noted in discussion:

·         Brush too thick and would like to clear some area to do test pits.

·         Want to clear right up to silt fence.

·         Lives at 19 Whippoorwill Lane and would like to stay in Town so therefore would possibly like to build a warehouse for my business with an apartment and sell house on Whippoorwill.

·         Wetlands are flagged and had soil scientist do report.   Will submit soil report at next regular meeting, July 27, 2015.

 

 

In discussion, Commission members noted:

·         Commission would like to conduct site visit.

·         Will look at quality of wetlands and what the wetlands connect to.

 

Thomas Stanford of 8 Whippoorwill Lane wanted to confirm location of proposed activity.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, July 27, 2015.  Tabled.

 

 

OLD BUSINESS

 

1.)    53 Judd Hill Road, Application #1238 submitted by Artur and Elizabeth Carreira for an Inland Wetlands Permit for a residential site development and pool

 

Present for this discussion was Fred D’Amico, P.E. of D’Amico Associates, Oxford, Connecticut, representing the applicants, Artur and Elizabeth Carreira, who were also present.

 

In discussion, Mr. D’Amico noted:

·         Added limits of clearing and stonewall to site plan.

·         Submitted copy of letter from Quinnipiack Valley Health District, dated June 17, 2015, approving the plans for septic system at 53 Judd Hill Road.

·         Pool will be a salt water pool which requires minimal backwashing.

 

Commission members discussed and proceeded to deliberate.  It was moved by Hathaway and seconded by Scanlon to approve Application 1238 submitted by Artur and Elizabeth Carreira for an Inland Wetlands Permit for a residential site development and construction of an inground pool in accordance with the following submitted plans prepared by D’Amico Associates, Oxford, Connecticut:

·         “Site Development Plan”, dated April 1, 2015, revised to June 1, 2015, page 1 of 2.

·         “Site Development Plan”, dated April 1, 2015, revised to June 1, 2015, page 2 of 2.

 

In addition, this permit is subject to the following condition including the standard conditions found on the Land Records Volume 93, Page 802 and Page 803:

·         The details for the operation, cleaning and maintenance of the pool shall be submitted for appropriate protection of the wetlands for discharge from the filter or the pool itself.

 

The Commission’s approval is based on the understanding that the plans as proposed will have minimal effect on the wetlands.

Voting were:  Breslin, Gaw, Hathaway, Scanlon.

Unanimous approval.

 

 

 

 

2.)    Raccio Road, Application #1234, submitted by the Town of Bethany for an Inland Wetlands Permit to remove and replace drainage system including catch basin’s and outfalls and reclaim road –

 

No one was present to speak on behalf of this application. The Commission will visit site with Consulting Engineer, Diversified Technology Consultants.  Received 65 day extension which will bring this application to July 30, 2015.

 

Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, July 27, 2015.  Tabled.

 

 

3.)    Show Cause Hearing regarding Cease and Desist Order, dated October 21, 2014, to Mrs. Bitina Patel of 10 Northrop Road, extension of patio, stonewall along the pond, waterfall and clear cutting of trees within the 150-foot upland review area without permit

 

No one present to speak on behalf of this activity.  Isabel Kearns, IWEO, stated she spoke with property owner and she had sent to owner certified letter dated May 29, 2015, regarding Cease and Desist Order dated October 21, 2014, and regarding he submit an application to the Inland Wetlands Commission which will include recommendations from Beth Evans report dated    May 19, 2015.  Tabled.

 

4.)    Revisit site in November the continue discussion regarding road and overland run-off

across 37 Hilltop Road (DeCesare) down to Route 69 -  Tabled.

 

5.)    Discussion regarding Bethany West clearing.  (Letter from Roman Mrozinski of the

Southwest Conservation District)Tabled.

 

 

6.)    185 Beacon Road, Discussion with Daniel Cusano regarding non-permitted barn

Tabled.

 

 

APPROVAL OF MINUTES

 

1.      It was moved by Gaw and seconded by Hathaway to approve, as amended, the minutes of the Tuesday, May 26, 2015, Regular Meeting.

Voting were:  Breslin, Gaw, Hathaway, Scanlon.

Unanimous approval.

The Commission scheduled a tentative site visit for July 11th or July 18th, 2015, to visit 33 Old Amity Road and 153 Amity Road.  Clerk to email absent members to check availability.

There being no further business to come before the Commission, it was moved by Hathaway  and seconded by Gaw to adjourn the regular meeting at 9:00 p.m.
