MINUTES OF THE BETHANY PLANNING AND ZONING COMMISSION REGULAR MEETING OF WEDNESDAY, OCTOBER 2, 2019         Page 1 of 6

 

The regular meeting of the Planning and Zoning Commission was called to order at  

7:03 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.

 

The following Commission Members were present:

            Kimberly McClure Brinton, Chairman

            Bob Harrison, Vice-Chairman

            Donna Shea, Member/Secretary

            Alex Hutchinson, Member

            Andy Zielinski, Alternate Member

 

The following Commission Member was excused:

APPROVAL OF MINUTES              

    

1.      It was moved by Harrison and seconded by Hutchinson to approve the minutes, as submitted, of the September 4, 2019, Regular Meeting.

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

Unanimous approval.

 

2.      It was moved by Hutchinson and seconded by Shea to approve the minutes, as submitted, of the September 18, 2019, Special Meeting/Site Visit/Hearing Continuation.

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

Unanimous approval.

 

 

BILLS

 

1.      It was moved by Harrison and seconded by Shea to approve the payment of $1,200.00 (monthly pro rata basis), for services rendered for September 2019, by Hiram W. Peck III, AICP, Planning Consultant.

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

Unanimous approval.

 

2.      It was moved by Harrison and seconded by Shea to approve the final payment of $5,000.00 to Hiram W. Peck III, AICP, Planning Consultant for work on the revision of the Bethany Zoning Regulations.

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

Unanimous approval.

 

 

 

 

3.      It was moved by Harrison and seconded by Hutchinson to approve the payment of a bill for $125.00, dated for October 2, 2019; from Donna Cahill for recording services for the public hearing (43 and 51 Russell Road).

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

Unanimous approval.

PUBLIC HEARING CONTINUATION

 

·         43 and 51 Russell Road, Application #2019-010 submitted by Bill and Wendy Grieger for a Special Exception Permit for outside storage of port-o-lets and heavy equipment for snow plowing.

 

At 7:15 p.m., Chair Brinton called the public hearing continuation to order.   Roll call was taken.  Chair Brinton read the notice for the public hearing continuation.

 

Also, Chair Brinton mentioned the Commission held a Special Meeting/Site Visit/Hearing Continuation on September 18, 2019, and members walked the subject property.

 

Present to speak on behalf of the application were Bill and Wendy Grieger, owners of record and applicants.

 

Hiram Peck, Planning Consultant, asked the applicant if he submitted the letter the Commission suggested at the previous public hearing on September 4, 2019, from the business that is storing the port-o-lets on specifics of how the operation is run and who is running it.  Mr. Grieger did not submit letter requested by the Commission.

 

 

 

 

 

During the course of the public hearing Chair Brinton noted that the Commission has received the following items relative to the subject application.  Exhibit identification was assigned as noted:

A.    Exhibit 2A – Letter from Hop Brook Storage, LLC, Bill and Wendy Grieger, dated September 30, 2019, Re:  Outside storage of port-o-lets, 43 and 51 Russell Road.

B.     Exhibit 2B – Submitted by Attorney Peter Berdon, copy of Bethany Zoning Regulations, highlighting Section 5.2.

C.     Exhibit 2C – Submitted by Attorney Peter Berdon, copy of Assessor’s map showing the subject property.

 

Chair Brinton asked if there were any members of the public who would like to speak in favor of the application.  No one from the public spoke.

 

Present to speak representing the Marinko’s of 55 Russell Road was Attorney Peter Berdon of 350 Orange Street, New Haven, Connecticut.  Attorney Berdon noted the following:

o   The Planning and Zoning Commission should have an application for a use permit from the renter.

o   The plan in the file does not meet the requirement of a site plan approval.

o   A narrative description of the use should be in the file.

o   For those procedural reasons, the Planning and Zoning Commission has no choice but to deny this application, without prejudice.

o   At the September 4, 2019, public hearing, Mrs. Marinko was not opposing the application.

o   There was a change in outside storage without a permit.

o   Port-o-lets stored up to wetlands.

 

Mr. Grieger stated that John Laudano of Quinnipiack Valley Health District, had no concerns and submitted an email dated May 22, 2019.  Also, Mr. Grieger noted the Inland Wetlands Commission issued an Inland Wetlands Permit approved on June 17, 2019.

 

Commission members discussed and determined that they would like to speak to their Town Legal Counsel. 

 

At 8:05 p.m., it was moved by Harrison and seconded by Hutchinson to recess the public hearing and continue the public hearing on the subject application to the next regular meeting scheduled for Wednesday, November 6, 2019, at 7:15 p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road.

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

NEW BUSINESS

 

1.      Discussion with Lois Noble of 400 Downs Road regarding two businesses/home occupations – No one was present for this discussion.  Tabled.

 

 

 

 

 

 

2.      Discussion with Matt Micros regarding release of landscaping bond, 667 Amity Road

 

Present for this discussion was Brian Matzke, CFC Partner.  Mr. Matzke stated Mr. Micros had a family emergency and could not attend this meeting.

 

Mr. Matzke stated back in June 2019, Ray Pantelone, Tree Warden and himself walked the property twice inspecting the landscaping.  Mr. Matzke also stated that the asbuilt was submitted a week ago and CFC feels they fulfilled the requirement for the bond.  Mr. Matzke then stated they are looking for a partial release of the bond. 

 

The Commission mentioned one of the conditions of approval for the bond was a one year growing season after planting to make sure plantings survive.

 

Hiram Peck, Planning Consultant, recommended comparing the asbuilt with the orginal approval.  Mr. Peck will visit the property, compare the plans and report back to the Chairman and ZEO.

 

3.      Discussion and possible action regarding vacant position on the South Central Regional Planning Commission – Bethany Representative

 

Michael Calhoun has resigned from the position as Bethany Representative on the South Central Regional Planning Commission.  After a brief discussion with Commission members, it was moved by Hutchinson and seconded by Shea to appoint Robert Harrison as the Bethany Representative to the South Central Regional Planning Commission due to the resignation of Michael Calhoun.

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

Unanimous approval.

 

 

4.      Discussion with Sun Power Solar regarding 194 Pole Hill Road – Wayne Bruno

The ZEO asked to have this item removed and stated that they are not ready to proceed.

 

 

OLD BUSINESS

 

1)      43 and 51 Russell Road, Application #2019-010 submitted by Bill and Wendy Grieger for a Special Exception Permit for Outside Storage of Port-o-lets

The public hearing on this application has been continued to the next regular meeting on November 6, 2019.

 

 

 

 

 

 

 

 

 

 

 

2)      Continue discussion regarding draft Zoning Regulations – Schedule a Special Meeting -

Hiram Peck, Planning Consultant, emailed the Final Draft dated September 30, 2019, which was distributed to all members.

 

In discussion, Mr. Peck noted:

o   He will prepare a general synopsis of what sections changed.

o   Post draft zoning regulations on Town website and synopsis.

o   Post hearing notice in Bethany Bulletin.

o   Put copy of draft regulations in the Library.

o   He asked Commission members to look at draft copy they received and compare with comments that they sent to Hiram.

 

It was moved by Harrison and seconded by Shea to schedule a public hearing date of Wednesday, January 15, 2019, at 7:00 p.m. in the Gymnasium of the Bethany Town Hall, 40 Peck Road, on the revised Bethany Zoning Regulations.

Voting for:  Brinton, Shea, Harrison, Hutchinson, White.

Unanimous approval.

 

 

ZONING ENFORCEMENT OFFICER’S REPORT

Isabel Kearns, ZEO, submitted the following reports:

·         Building Permits, dated September 5, 2019 to September 27, 2019.

·         Site Visits, dated September 6, 2019 to September 26, 2019

 

 

OTHER BUSINESS

Barbara Schellenberg, Land Use Attorney, will conduct a workshop with the Commissions and Boards.  The clerk will contact Attorney Schellenberg to check dates in November 2019 for availability and then contact Commissions and Boards.

There being no further business to come before the Commission, it was moved by Harrison and seconded by Hutchinson to adjourn the regular meeting at 8:43 p.m.

Bethany Airport Restoration Committee

Meeting Minutes

January 26, 2017

The meeting was called to order at 6:40PM.

 

MEETING MINUTES

A motion to approve the October 27, 2016 meeting minutes was made by Janet Brunwin and seconded by Tracy Darling.  Motion carried with 2 abstentions.

 

TREASURER’S REPORT

A motion to accept the November and December Treasurer’s Reports was made by Tracy Darling and seconded by Janet Brunwin.  Motion carried.

 

CORRESPONDENCE

Fran Doba produced a proposal sent by Sign Craft to create the front signage for the hangar:

                Option 1:  Aluminum plate letters bolted to building                        $9,058

                Option 2:  3/8” Acrylic Plate Letters riveted to the building            $6,697 *

                Option 3:  Hand painted lettering                                                              $5,900

 

*Option recommended by Sign Craft.  Said they won’t chip or fade.  Art said he believed the warranty was 20-years.  Fran Doba made a motion to approve Option 2 seconded by Vinnie CoFrancesco.  Motion carried.  Art said we need to do this before the insulation and curved paneling is installed.  Fran will check on purchase order protocol but the team agreed this will be paid out of the Donations account.

 

PROJECT STATUS

Parts of the floor still show standing water after a heavy rainfall although less than in the fall.  There is a conflict between Pat Munger Construction and Steel Master as to what is the solution to fix the problem.  First Selectman, Derrylyn Gorski has sent the matter to Town Attorney, Kevin McSherry.

 

CERTIFICATE OF OCCUPANCY

Janet Brunwin asked if there is a checklist of work to be done that, once completed, would enable the town to obtain a COO.  Fran said she would check with Isabel Kearns to see if she can find out from Bob Walsh.

 

WEBSITE DOCUMENTS

Tracy suggested putting the Donation and Brick forms out on the Town website for easy access by residents.  Fran said she will do this ASAP.

 

STRATFORD’S CURTIS HANGAR

Janet said she had just read an article citing a $500,000 grant to the Connecticut Air and Space Center at Bridgeport Airport to restore the Curtis Hangar.  She will forward the article for the committee’s review.

MINUTES OF THE BETHANY INLAND WETLANDS COMMISSION REGULAR MEETING OF MONDAY, SEPTEMBER 16, 2019, CONTINUED ON      SEPTEMBER 23, 2019                                                                                          Page 1 of 4

 

The regular meeting of the Inland Wetland Commission was called to order at 7:31p.m. in the Commission Meeting Room of the Bethany Town Hall, 40 Peck Road, Bethany, Connecticut.  The meeting was scheduled for September 16, 2019, due to lack of quorum was continued on Monday, September 23, 2019.

 

 

The following members of the Inland Wetlands Commission were present:

         Kristine Sullivan, Chairman

         Charles Clark, Member

         James Nickle, Member

         Anjuli Cokic, Member

 

The following member of the Inland Wetlands Commission was excused:

         Nancy Scanlon, Member

 

 

Also present was Isabel Kearns, Inland Wetlands Enforcement Officer

 

 

NEW BUSINESS 

 

1.      256 Amity Road, Capasso, Discussion by the Commission for appropriate action.

 

No one was present for this discussion.  The Commission is concerned with the wetlands on the property and possible work being done in rear and north side of the building.  Mr. Capasso is not complying to meet Inland Wetlands Commission on his property.  The Commission will send an informational letter requesting the Commission be allowed to conduct a site visit.  Tabled.

 

 

OLD BUSINESS

 

1)      Discussion with Karl Larson of 80 Bethmour Road, regarding platform steps

 

Present for this discussion were Karl Larson and Caitlin Nugent, owners of record.  Mr. Larson reviewed with the Commission some possible ideas they were considering for the outside steps and whether or not they would be able to do this. 

 

The Commission stated he will need to submit a letter requesting what they would like to propose and show where path is and narrative describing proposal.  The Commission would schedule a site visit to determine if the owners would need an Inland Wetlands permit or not.

 

 

 

 

 

 

 

 

 

2)      40 and 44 Peck Road, Application #1322 submitted by the Town of Bethany for an IW Permit for routine maintenance of plunge pools

 

No one was present for this application.

 

The Commission visited the site on September 7, 2019, checked the outlet work that was completed and determined the work looks satisfactory. 

 

The Commission proceeded to deliberate.  It was moved by Sullivan and seconded by Clark to accept and approve Application #1322 submitted by the Town of Bethany for an after-the-fact Inland Wetlands Permit for routine maintenance of the plunge pools located at 40 and 44 Peck Road (Bethany Community School) as presented in the application and in accordance with the submitted plan, titled, “Site, Grading & Utility Plan, Town Hall Parcel”, received May 29, 1997, including the standard conditions found on the Land Records, Volume 93, Page 802 and Page 803.

 

This approval is based on the fact that the maintenance of the plunge pools will protect the adjacent wetlands and watercourse that feeds down to Lake Chamberlin. 

Vote 4 to 0.

Voting for:  Sullivan, Clark, Nickle, Cokic.

Unanimous approval.

 

 

3)      39 Round Hill Road, Application #1323 submitted by Kathleen LaTronica for an IW Permit for a new drainage pattern

 

No one was present representing the applicant.

 

The applicant was to provide drainage calculations but the Commission has not received them at this time.

 

Present to address their concerns were Adam and Kiyan Bakhtiari of 47 Round Hill Road.

Mr. Adam Bakhtiari submitted and email, dated September 22, 2019, in regard to the drainage from 39 Round Hill Road.  Mr. Kiyan Bakhtiari reviewed the excessive runoff concerns with the Commission as mentioned in the email, dated September 22, 2019.

 

Chair Sullivan stated that when the drainage calculations are submitted, the clerk will forward a copy to the Bakhtiari’s and the Commission’s Consulting Engineer.  Also, Chair Sullivan requested the applicant submit a soil survey to determine what’s out there.  The Inland Wetlands Enforcement Officer will contact the applicant. 

 

The applicant may need to submit an extension of time for the Commission to act on this application.  Further discussion and appropriate action on the application was deferred until the Commission’s next regular meeting adjourned to Monday, October 21, 2019.
